In a motion filed Nov. 15 in a California federal court, plaintiffs in the class action lawsuit filed against Mondelez International Inc. asked a judge to approve their proposed settlement.
The belVita class action lawsuit was filed in November 2017, claiming that Mondelez International Inc. fraudulently marketed their belVita biscuits as healthy. Instead of being a nutritious breakfast option, the belVita products are full of sugar, the plaintiffs said.
Over the years, Mondelez sought to dismiss the belVita class action, prompting plaintiffs to fight the case at multiple junctures.
BelVita Class Action Settlement Includes Rebates, Label Changes
The settlement, if approved, would benefit Classes of biscuit buyers nationwide who purchased the product between November 2013 and the date that the court grants preliminary approval.
Class Members without proof of purchase can make claims for $0.21 per purchase of the biscuits, up to two per month, and those with proof of purchase can claim for an uncapped amount.
The three named plaintiffs will seek $5,000 each, and lawyers are seeking $2.67 million, the motion states.
Mondelez has also agreed not to use the term “nutritious” on its products, or substitute the words “healthy,” “balanced” or “wholesome” for “nutritious” on its Steady Energy products, including belVita biscuits.

Ha! As usual looks like lawyers won out! They get 2.67 MILLION dollars and the three idiot plaintiffs get a whopping $5000 each. In California that will buy you about 42 tanks of gas nowadays. Hope they are happy.
Would the yuppies in California quit telling what to eat! Please! What a bunch of morons, we know how to read a contents label, and if it’s fine with us, then it is no business of theirs. They DON’T have to buy them if they don’t like them, they could just as easily go outside and pick off some pine tree bark and chow down.
