Nature's Way coconut oilNature’s Way and a group of customers have reached a $1.8 million settlement deal that, if approved, would end class action claims that the company falsely advertises its coconut oil as being healthy.

The proposed Nature’s Way class action settlement would provide between $3 and $6 per jar of extra virgin coconut oil purchased, or between $3.50 and $6 per jar of liquid coconut cooking oil.

For customers with proof of purchase, there is no cap on the number of products for which they can seek compensation, customers without proof of purchase may only claim three products.

In the Nature’s Way class action settlement, the customers’ attorneys are seeking up to one third of the fund amount — around $610,000. The proposed coconut oil class action settlement notes that Class representatives would receive no more than $7,500.

In addition to the monetary benefits provided in the proposed coconut oil class action settlement, Nature’s Way has agreed to stop advertising its products with slogans such as ”healthy” or “ideal for exercise and weight loss programs” for at least five years.

Under the settlement agreement, these terms would apply unless regulations around food labeling were to change.

Reportedly, Nature’s Way has already remove claims of the coconut oil products being “healthy” and “ideal for exercise and weight loss programs” while the coconut oil class action lawsuit was underway.

The Nature’s Way coconut oil class action lawsuit was filed by Sherry Hunter, and the case was removed to federal court in March 2016.

According to Hunter, Nature’s Way violated both federal and California state laws regarding food regulations. Hunter asserted that coconut oil is actually not a healthy alternative to other oils.

Hunter notes that coconut oil contains 100 percent fat and 93 percent saturated fat.
