Nature’s Way Products LLC has agreed to pay $1.8 million to resolve claims that the misleadingly marketed their coconut oil as healthy.

The settlement will benefit consumers who purchased Nature’s Way Extra Virgin Coconut Oil in 16 oz. or 32 oz. jars or Nature’s Way Liquid Coconut Oil in a 10 oz. or 20 oz. bottle between Jan. 28, 2012 and Aug. 30, 2019, where the products contained one or more “healthy” claims. More information about these claims is available in the “Who’s Eligible” section below.

Plaintiff Sherry Hunter filed a class action against Nature’s Way in 2016, claiming that the company couldn’t market their products as healthy when they contained 100 percent fat and 93 percent saturated fat.

Despite this, the company’s products were allegedly marketed as “inherently healthy,” able to serve a “variety of healthy uses,” and “ideal for exercise and weight loss programs.”

Hunter’s claims were dismissed by U.S. District Judge William Q. Hayes, but Hunter moved for reconsideration of this decision in November 2017. Hunter urged the judge to apply a new decision by the Ninth Circuit Court of Appeals. After doing so, Judge Hayes resurrected Hunter’s claims with leave to amend.

In July 2019, Nature’s Way agreed to pay $1.8 million to resolve the claims against them, although the company does not admit any wrongdoing. The settlement was granted preliminary approval on Aug. 30, 2019.

Under the settlement, Class Members who file a valid claim can recover $3 for a 16 oz. jar of semi-solid Extra Virgin Coconut Oil, $6 for a 32 oz. jar of semi-solid Extra Virgin Coconut Oil, $3.50 for a 10 oz. jar of Liquid Coconut Oil, and $6 for a 20 oz. jar of Liquid Coconut Oil.

Proof of purchase is required if Class Members wish to submit claims for an unlimited number of purchases. Without proof of purchase, Class Members can only claim three units.

Class Members need to file a valid Claim Form by Oct. 31, 2019 in order to receive payment. The deadline for exclusion is Oct. 31, 2019. If Class Members wish to object to the settlement, they need to do so by Nov. 25, 2019. The final approval hearing is scheduled for Dec. 13, 2019.

Who’s Eligible

Consumers who purchased Nature’s Way Extra Virgin Coconut Oil in 16 oz. or 32 oz. jars or Nature’s Way Liquid Coconut Oil in a 10 oz. or 20 oz. bottle between Jan. 28, 2012 and Aug. 30, 2019, where the products contained one or more of the following claims:

  • “Healthy”
  • “Ideal for Exercise and Weight Loss Programs”
  • “Recommendation: Take 1 tablespoon (14 g) up to 4 times daily”
  • “Non-hydrogenated, no trans fat,” unless the statement, “See Supplement Facts for total fat and saturated fat content,” was displayed near the phrase “Non-hydrogenated, no trans fat”
Potential Award

$3 for a 16 oz. jar of semi-solid Extra Virgin Coconut Oil, $6 for a 32 oz. jar of semi-solid Extra Virgin Coconut Oil, $3.50 for a 10 oz. jar of Liquid Coconut Oil, and $6 for a 20 oz. jar of Liquid Coconut Oil.

Proof of Purchase

Proof is required to validate an unlimited number of purchases. Without proof of purchase, consumers can only claim three units.
