A class action lawsuit says the labeling of One Bars are misleading because the labels give the impression that the nutrition bars are low in carbohydrates.
Plaintiff Jose Melendez claims that One Brands LLC misrepresents more than a dozen protein bars in the company’s lineup, including their Birthday Cake, Cinnamon Roll, Cookies and Cream, and Maple Glazed Donut items.
The One Bar class action lawsuit states that reasonable consumers look for high protein snack foods that are also low in carbohydrates.
According to the One Bar class action, the representations on the label of the snack bars contrast the macronutrient – protein with a component of another macronutrient – carbohydrates rather than list the total number of the carbohydrates inside those products.
The One Bar class action lawsuit states that the front label of the bar shows 20 grams of protein and 1 gram of sugar, therefore customers would reasonably assume the product is low in carbohydrates.
As explained in the One Bar class action lawsuit, consumers are under the impression that this is a convenient and healthy snack because of the misleading information published on the label. The bars have a focus on the word “one” published on the label and highlight the one gram of sugar.
The One Bar class action lawsuit argues that because the front of the label chooses to emphasize the grams of protein and the one gram of sugar that consumers would not expect that the carbs inside the product would be so high.
The One Bar class action lawsuit seeks to represent a Class of consumers in the state of New York who purchased any of the involved products with actionable representation during the applicable statutes of limitation.
The plaintiff in the One Bar class action lawsuit purchased one or more of the named products across 2017 and 2018 for personal use under the impression that the levels of carbohydrates were low.
The One Bar class action lawsuit says that the defendant’s claims on the label of the bar are misleading, deceptive, and false all because consumers cannot make an informed decision about their purchases.
Melendez says that he made a decision to purchase the One Bar products because of the information included on the front of the package, which led him to believe that this was a healthy snack with low carbohydrates.
The plaintiff has filed this One Bar class action lawsuit alleging false advertising as well as unjust enrichment by the company.
One Brands is accused of purposely not disclosing the true level of carbohydrates on the front of the package, choosing instead to feature more appealing details about the products.
The plaintiff in the One Bar class action lawsuit is represented by Spencer Sheehan of Sheehan & Associates PC and Joshua Levin-Epstein of Levin-Epstein & Associates PC.
The One Bar Carbohydrates Class Action Lawsuit is Jose Melendez v. One Brands LLC, Case No. 1:18-cv-06650, in the U.S. District Court for the Eastern District of New York.
