Nestle coffee-mate - Walmart class action lawsuit

A Florida consumer says that Walmart, Inc and Nestlé USA misrepresent the number of servings in Coffee-mate coffee creamer products which are labeled as containing “500 servings,” but actually contain far less. 

Lead plaintiff, Julia Yonan wants to represent other Florida consumers she says were deceived by Walmart and Nestlé into purchasing packages of Coffee-mate that contain far less coffee creamer than advertised. In the Walmart Nestlé class action lawsuit lodged in Florida federal court Thursday, Yonan says that the companies dupe consumers into paying more by falsely labeling certain Coffee-mate products.  

Yonan says that she purchased the 35.3-ounce package of Coffee-mate creamer at Walmart in February because it claimed to contain 500 servings. She says that the front label of the product included a “prominent” statement indicating the Nestlé product “Makes Over 500 Servings.” 

“Based on this prominent labeling and based on the serving size listed on the Product, a consumer purchasing this Product would reasonably believe that the Product contains at least 500 servings of powdered coffee creamer,” states the Walmart Nestlé class action lawsuit. 

The class action lawsuit points out that Nestlé and Walmart could have refrained from displaying the number of servings of Coffee-mate consumers could expect, or ensured that labeling was accurate, on the products’ packaging.  

However, the Coffee-mate sold at Walmart “does not contain anywhere close to 500 servings of powdered coffee creamer” advertised and Yonan says that she and other Florida consumers would not have purchased or paid as much for the product had they known. 

The plaintiff accuses Nestlé and Walmart of violating Florida consumer protection laws. Yonan wants to represent Florida residents who purchased Coffee-mate that purported to contain 500 servings. She says the companies should pay Class Members the premium that they paid for the mislabeled Coffee-mate and stop falsely advertising the product.  

The Walmart Nestlé class action lawsuit filed in Florida is not the first to claim that Nestlé comes up short concerning the number of servings represented on Coffee-mate products. Last week, an Illinois consumer lodged a class action lawsuit against Nestlé claiming the company falsely labels products that contain approximately one-third less than the 140 servings advertised.
