Xerox Versant Digital Presses Class Action Lawsuit Overview: 

  • Who: Neala Communications LLC filed a class action lawsuit against Xerox Corporation. 
  • Why: Neala claims Xerox manufactures, markets, and sells certain Versant digital presses that use defective toner and contain defective component parts. 
  • Where: The class action lawsuit was filed in New York federal court. 

Xerox Corporation manufactures, markets, and sells certain Versant digital presses that contain defective component parts, a new class action lawsuit alleges.

Plaintiff Neala Communications LLC claims Xerox actively chooses not to fix the problem and instead continues to sell the allegedly defective digital presses to “unwitting consumers.” 

Neala claims further that the affected Versant digital presses use defective toner that is manufactured and distributed by Xerox, which either triggers, causes, or exacerbates the issue. 

“The presses, by virtue of their defects, are susceptible to inconsistencies in the toner products,” the class action lawsuit states. “Those inconsistencies, which have been observed in a substantial percentage of the relevant toner products, trigger the defects in the presses and cause damage to various components thereof, including drums, rollers, and developer housings.”

Neala wants to represent a nationwide Class of persons or entities who purchased a Xerox Versant 80, Xerox Versant 180, Xerox Versant 2100, or Xerox Versant 3100 digital press. 

Neala says it has been leasing two V180 presses from Xerox on a 60-month term since January 2019. The lease includes a maintenance plan and an option to purchase the press for fair market value, according to the class action lawsuit. 

Xerox Required To Keep Presses In ‘Good Working Order’

Neala argues Xerox is failing to honor its maintenance plan, which requires the company to keep the digital presses in “good working order,” by providing on-site support, necessary repairs, and replacement parts. 

“[The] defendant has failed to maintain the presses and keep them in ‘good working order’, and the defendant has failed to replace the presses as it is contractually obliged to do,” the class action lawsuit states. 

Neala claims individuals who purchased the affected Versant digital presses did not receive the benefit of their bargain and suffered from overpayment due to print costs, wasted material, and other out-of-pocket expenses. 

Neala claims Xerox is guilty of breach of contract, negligence, and unjust enrichment, and in violation of the Lanham Act and New York General Business Law. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with actual, compensatory, statutory, and punitive damages for itself and all Class Members. 

A separate class action lawsuit was filed against Xerox last year by employees arguing the company inflated recordkeeping fees they were required to pay in order to participate in its pension benefits plan.

    We have had the same issues, defective drums for months, then bad toners for months.
    The worst is the 2nd Btr, it does not last at all, and does not stop printing at all, just prints with lines all over it. So sometimes you catch it at 100 bad sheets, sometimes you print 800 before you see it. So you need to spend more time babysitting the printer.

    It used to be you have the techs that come fix it a box of all the bad sheets that went through, and you would get a credit.
    Now they refuse to give you a credit for anything, it can become quite costly, as I have to spend extra time watching the printer and whats coming out, all the time the printer is out of commission till they come fix it, and then a ton of overtime to get caught back up after. Plus the bad prints, we pay for the paper and the clicks. Sometimes I get a week out of the 2nd Btr, this last one lasted 3 days.

    We have had similar issues but my main issues lies with the Ex80 rip and most jobs that print have a pixelated issue. We had had the software reloaded 3 times, created new profiles to no avail. Xerox engineers cannot fix, software support have no clue so the machine is unusable! The 2nd btr needs changing around every 20k prints totally unreliable V80.

    Sign me up. I have spent thousands on Drums & Toner. I have also lost money on multiple projects due to supplies problems. I have sent my invoices and receipts, they don’t care.

    Urgent help needed. I purchased by sale contract v180 in November 2019 and was faulty on a spot as it was turned on. I refused the goods and to pay until new engine delivered. turned up I’m tide up in rental agreement based on forged signatures they even took initial payment by DD. Now I’m sued for breach of contract I never signed and banned me from supplies for my old 560 as well. 3 years on and V180 not working and just takes the space of my premises as vendor refuses to take it back and Xerox Finance claims it is their machine but not proof of ownership shown. They using lies in particulars of claim, in witness statements as well, evidence is based on forged documents (got proofs for everything), found out that V180 is a refurbished model (not new as stated in sales contract) but somehow they still feel confident with their claim and court is always on their side. I feel I’m in discovery of some sort of “sale of refurbished as new” scam. 560 bought 8 years ago just found up it wasn’t new but refurb. They ruined my life by harrasing, cornering, not able get service and supplies and damaged my reputation and credibility so I can’t buy any other brand and 25 years old successful business is on its knees and in stake because of them. Final hearing is on September 14. Please if anyone can help in any kind I would be more than grateful. Thank you!

    Xerox signed us up for a lease on a Versant 180 in December of 2020, virtually right off they started slow shipping supplies then it got real bad. Had to lease a Canon and now waiting on a class action lawsuit to put Xerox out of business so we can tear up the unreasonable contract we signed. Can’t get toner now at all, all of last year we had to deal with the drum shortages and toner issues now it’s toner shortages. Sign us up for a class action lawsuit and destroy this unscrupulous company!

    I’ve been with Xerox for many years. I’ve had the same issues as everyone else. Defective drums, cant get toner or other supplies, many wasted and spoiled jobs. I don’t know how they are able to get away with not living up to their end of the contract.

    We’ve had a V180 for three years. We really liked the machine and the product it put out until a year or so ago when we started seeing the same problems described here. We were also told the issue was drums for a long time and we have had to fight and scrape to get Xerox to send us replacements. They always claim that based on percentages we can’t have used up the current drums yet which is mind boggling because surely they know why we’re asking for new drums. I’ve been committed to Xerox for a lot of years but I’m now talking to Canon about our next replacement as this experience (and the lack of transparency from Xerox) has caused me to lose faith in them.

    We have a Versant 180 and it’s been a disaster from day one. Discounting the fact that every word out of the sales manager’s mouth was an outright lie, this machine has had every problem described above and more. It is a poorly designed and poorly constructed machine not up to the demands of even a casual print user much less a commercial print shop. I wouldn’t wish this piece of crap on my worst enemy.

    Same problems here. Drums are constantly failing with speck damage on the drum surface. First we were told they were bad drums, then the story change to being bad toner. We ran out of good drums and Xerox couldn’t ship any because they were backordered. We’ve had to spend money on drums and parts to keep our V180 running because Xerox parts have been on backorder. Now we can’t get toner because it’s backordered and we’ve had to order our own toner from a third party, so it’s like we’re paying for toner twice when we print. Still no word from Xerox when Magenta or Black toner will ship. Latest word from one of our techs is that Xerox is redeveloping the toner manufacturing for the Versant, making a smaller particle. If Xerox can’t start shipping reliable toner soon we’ll have to purchase a machine from a different manufacturer and dump Xerox.
