gamestop storeA GameStop class action lawsuit claims that the company refuses to grant refunds, even for items that are ordered online but never delivered.

The GameStop refunds class action lawsuit was filed by A. Gliewski who says he purchased several products from GameStop online including games and a game console. Allegedly, he even paid extra for one-day shipping.

However, Gilewski claims that the game console wasn’t delivered, despite him being charged for it. Allegedly, he complained to the company, but was not refunded. Gilewski asserts that the company is still withholding his money.

According to the GameStop class action lawsuit, Gilewski complained to GameStop and asked that his entire order be delivered, but this effort was not successful.

The GameStop class action lawsuit says that repeatedly, he was told by GameStop customer service that his item would be shipped. However, this allegedly never occurred. 

Gilewski states that he was also informed via email that the company would refund the products if he returned them. So, Gilewski allegedly returned the games he received because he could not play them without the gaming console that never arrived.

The GameStop class action lawsuit goes on to assert that after Gilewski returned his games, he never received his promised refund.

Gilewski asserts that these occurrences were not “innocent mistakes,” and were actually part of a company-wide practice or scheme to cheat customers out of their money. 

The GameStop class action states that the company knowingly makes misrepresentations to customers promising them the delivery of items and promising them refunds that are never granted.

Allegedly, Gilewski went in-person to a GameStop store near him to speak to an employee about his refund. He says that he was again promised a refund after the matter was investigated, but he never received a refund.

To support the claim that GameStop makes a widespread practice of not giving promised refunds, the video game class action lawsuit cites numerous online reviews and complaints from customers who have experienced similar occurrences.

Gilewski asserts that he and many other consumers were financially injured by GameStop because had they known that they would not receive a refund or would not receive the items they were promised, they would have spent less money with the company or would not have purchased from GameStop at all.

Allegedly, GameStop received unjust enrichment from the scheme of misleading customers and cheating them out of money. Gilewski seeks damages on behalf of himself and all other similarly affected consumers.

The GameStop class action was originally filed in California state court but was removed to federal court on July 19.

Gilewski is represented by Steven C. Gonzalez and Giacomo Gallai.

    You can add me too, I returned an item and was promised a refund within 3-5 business days, after 8 business days went by I called back asking about my refund and I was told a refund hadn’t be issued in the first place and I had to wait 3 weeks for it to be started. This is the second time this has happened to me

    Please Add me to this. I ordered a Visio tv 1800 dollars they said it would ship with in two days. And guaranteed 4 days to deliver. 12/28/20 purchase date. After not seeing this for a a week I called and the said it would ship the next day. Never received any shipping info and it never shipped called again and they told me the item could not be shipped and would have to cancel. Then my card was charged for it!! I called 1/8/21 and they said the refund was started and I would revive my money 3-5 business days. Never got it. Called and they said it wasn’t filed correctly and would got to a manager and expedite the process. Still no refund or tv. I have called two more times and I get a different story every time. I’m so upset just want my money back.

    I just bought a $20 digital Xbox gift card and the code was already redeemed. If I don’t get a replacement or refund, then I’ve had enough with them.

    I purchased the Oculus Quest 2 in store on 12/12/20 and was told it would be mailed to me between 12/18 -20/20. My debit card was charged $478.00 on 12/14/20. Your website states that you are not charged until your item ships. I received an email on 12/20/20 telling me that my item would not be arriving until 12/25/20 (Christmas day). Knowing that it would not be delivered in time for Christmas (there are no deliveries on Christmas) I canceled my order. I assumed my credit card would automatically be refunded in 5-7 days, as is standard with most companies. I allowed time for the holiday and had not received my refund by 12/30/20. I called the customer service number provided on GameStop.com and after waiting to speak to someone for 45 minutes I was disconnected. Feeling very frustrated I decided to call back the next day. I called on 12/31/20 and finally got to speak to someone. I was told that the only way I could receive a refund was in the form of a virtual gift card that would arrive in 1-3 days via email and with this virtual gift card I would have to go to the store and request cash. This, I was told, was MY ONLY OPTION and that simply refunding my card was not possible. Seeing that I had no other choice, I accepted this option. Well three days came (and went) and I never received an email so I called Customer service on 1/8/21 and I spoke to someone that told me that he sees my request for a refund but it was NEVER PROCESSED. He placed me on hold for 3 minutes and when returned he assured me that my $478.00 would be refunded within 24 hrs directly to my bank account. Well today is 1/11/21 and I STILL DO NOT HAVE MY REFUND. Why can’t I just get my $478.00 back and be done with GameStop?

    I ordered two products from GameStop back in November which I have never received. Both products said “Awaiting Product Availability” on the website despite being assured by the customer service rep (after sitting for 2 hours on hold) that the products were in-stock.

    I asked if it would be easier to just get a refund for the products, and the customer service rep told me we could do that if I wanted. So I asked them to cancel/refund the products. Both products were changed to “cancelled” on their website, but I still haven’t received my refund and it has now been over a month since I was promised the refund. I was charged for both products immediately at the time of ordering.

    Add me, ordered a switch 2 weeks ago, still awaiting carrier pickup. Will not allow me to cancel or get a refund. GAMESTOP STRAIGHT OUT STOLE OVER 500 DOLLARS OUT OF MY BANK ACCOUNT!!!

    Ordered 400 game console, money was debited from account the 20th of December stated delivery the 31st. No confirmation or email that it shipped to be able to know who and when and use a tracking option. Called a local store as it is now the 3rd of January. Salesmen look up info state it was delivers to my address via USPS on the 24th!! No console !!! Awaiting on phone with corporate to find out all the facts of its true and what to do next, hoping I’m not out! This was my sons only Xmas present and a huge deal as I’m not one to ever have that money to spend like that. First time ever. I’m sick over it.
