gamestop storeA GameStop class action lawsuit claims that the company refuses to grant refunds, even for items that are ordered online but never delivered.

The GameStop refunds class action lawsuit was filed by A. Gliewski who says he purchased several products from GameStop online including games and a game console. Allegedly, he even paid extra for one-day shipping.

However, Gilewski claims that the game console wasn’t delivered, despite him being charged for it. Allegedly, he complained to the company, but was not refunded. Gilewski asserts that the company is still withholding his money.

According to the GameStop class action lawsuit, Gilewski complained to GameStop and asked that his entire order be delivered, but this effort was not successful.

The GameStop class action lawsuit says that repeatedly, he was told by GameStop customer service that his item would be shipped. However, this allegedly never occurred. 

Gilewski states that he was also informed via email that the company would refund the products if he returned them. So, Gilewski allegedly returned the games he received because he could not play them without the gaming console that never arrived.

The GameStop class action lawsuit goes on to assert that after Gilewski returned his games, he never received his promised refund.

Gilewski asserts that these occurrences were not “innocent mistakes,” and were actually part of a company-wide practice or scheme to cheat customers out of their money. 

The GameStop class action states that the company knowingly makes misrepresentations to customers promising them the delivery of items and promising them refunds that are never granted.

Allegedly, Gilewski went in-person to a GameStop store near him to speak to an employee about his refund. He says that he was again promised a refund after the matter was investigated, but he never received a refund.

To support the claim that GameStop makes a widespread practice of not giving promised refunds, the video game class action lawsuit cites numerous online reviews and complaints from customers who have experienced similar occurrences.

Gilewski asserts that he and many other consumers were financially injured by GameStop because had they known that they would not receive a refund or would not receive the items they were promised, they would have spent less money with the company or would not have purchased from GameStop at all.

Allegedly, GameStop received unjust enrichment from the scheme of misleading customers and cheating them out of money. Gilewski seeks damages on behalf of himself and all other similarly affected consumers.

The GameStop class action was originally filed in California state court but was removed to federal court on July 19.

Gilewski is represented by Steven C. Gonzalez and Giacomo Gallai.

    I went in to return an item and they just have me a store gift card because I had paid 30% of the purchase with a store gift card and the rest I paid with my credit card. Now I’m stuck with store credit I don’t need. When I need to pay my credit card back. They have a terrible return policy. Add me!
