Juul Vaping Misrepresentation MDL Overview:
- Who: Brandywine School District, Griffith Public Schools, and Caesar Rodney School District joined multidistrict litigation (MDL) against Juul Labs Inc.
- Why: The school districts claim Juul misrepresents the safety of its e-cigarette devices and targets the youth demographic.

Three more school districts have joined sweeping multidistrict litigation (MDL) against Juul Labs Inc. over claims the company targets youth and misrepresents its e-cig products as safer than traditional cigarettes.
Plaintiffs Brandywine School District, of Delaware, Griffith Public Schools, of Indiana, and Caesar Rodney School District, of Delaware, claim Juul has exacerbated an underage nicotine crisis that was trending in the right direction before it brought its products to market.
“The United States, closer than ever to consigning the nicotine industry to the dustbin of history, now faces a youth nicotine epidemic of historic proportions,” the school districts say.
The school districts claim Juul has intentionally marketed its e-cigarette devices to youth consumers by making their devices “slick” and “high tech” with “kid-friendly flavors.”
“(Juul) knew they would need to create and market a product that would make nicotine cool again, without any of the stigma associated with cigarettes,” the school districts say.
The school districts claim Juul has made it a practice of using social media influencers known by teens to market their products and even sent representatives directly into schools to market to underage teens.
Juul also has been misleading consumers about the dangers of its product, as well as “grossly understating” the amount of nicotine that its products contain.
“Advertising campaigns featured JUUL paired with food and coffee, positioning JUUL as part of a healthy meal, a normal part of a daily routine, and as safe as caffeine,” the school districts say.
The school district’s claims against Juul include negligence, gross negligence, and violations of the Racketeer Influenced and Corrupt Organizations Act and individual states’ public nuisance laws.
Juul Faces Mounting Litigation Alleging it Fueled Youth Vaping Epidemic
Two other school districts, Colonial School District and New Castle County Vo-Tech School District, also joined the MDL against Juul earlier this month.
Also this month, Juul asked a federal judge to choose two school districts as the first government entities to testify in bellwether trials set to take place over the claims.
