Juul Vaping Class Action Lawsuits Overview:

  • Who: Colonial School District and New Castle County Vo-Tech School District have joined multidistrict litigation (MDL) against Juul Labs Inc.
  • Why: School districts claim Juul Labs targeted the youth demographic with its vaping devices, exacerbating what they call an underage nicotine epidemic.
  • Where: The MDL is being heard in California federal court.

Juul Labs Inc. is facing class actions lodged by two additional school districts that claim the company targets youth and misrepresents its vaping devices as safer than regular cigarettes.

Colonial School District and New Castle County Vo-Tech School District are seeking to join multidistrict litigation (MDL), which seeks to hold Juul Labs accountable for its role in the rise of underage nicotine use.

Colonial and New Castle claim Juul Labs created campaigns that “strategically laced social media with false and misleading messages to ensure their uptake and distribution among young users.”

“The United States, closer than ever to consigning the nicotine industry to the dustbin of history, now faces a youth nicotine epidemic of historic proportions,” Colonial and New Castle say.

Juul Fueled Addiction in Youth, Say Schools’ Class Actions

New Castle and Colonial also reiterate earlier claims that Juul Labs developed its devices specifically to enable them to deliver more nicotine to users, fueling addiction.

“Seeking to build and dominate a new market for nicotine products without the baggage of combustible cigarettes … JLI engineered a cool-looking e-cigarette device capable of delivering more nicotine and fueling higher levels of consumer addiction than ever before,” the school district’s say in their class action complaints.

Juul Labs also specifically targeted the youth demographic through sophisticated viral marketing campaigns, the school district’s argue.

The Juul Vaping Misrepresentation MDL is In re: Juul Labs Inc. Marketing, Sales Practices and Products Liability Litigation, Case No. 3:19-md-02913, in the U.S. District Court for the Northern District of California.
