Juul Vaping MDL Overview: 

  • Who: Minor, adult, and school district plaintiffs have joined the multidistrict litigation against Juul Labs, Inc. 
  • Why: The MDL is in response to allegations Juul marketed and sold vaping products to minors and adults that caused consumers to suffer physical, mental, and cognitive injuries.
  • Where: The MDL is being litigated in California federal court.

More plaintiffs are joining multi district litigation against vaping company Juul over claims the company and its partners marketed and sold vaping products which caused mental, physical, and cognitive injuries. 

Plaintiffs range from minors, to adults, to school districts. One minor recently filed a complaint alleging the company’s products caused them to develop behavioral, mental health, and cognitive issues. 

In addition to becoming addicted to their Juul device, the minor plaintiff claimed the product led them to suffer from bouts of anger, outbursts, trouble sleeping, and difficulty concentrating. 

The plaintiff also claimed using their Juul caused shortness of breath, chest tightness, chronic cough, headaches, nausea, vomiting, and stomach aches, among other things.

Underage use of Juul devices has also caught the attention of behavioral institutions, including the Holy Hill Area School District, which filed a complaint against Juul, claiming the company and its partners go out of their way to market and sell vaping products to minors. 

“(Juul’s) mission was not to improve public health. Rather, (Juul) sought to introduce a new generation of users to nicotine,” states their complaint. 

The Tuscaloosa Intermediate School District also filed a complaint against Juul, arguing the company advertises flavors that would appeal to kids and young adults to try and get them hooked on their vaping products. 

“JLI’s use of flavors unfairly targeted not only youth, but unsuspecting adults as well,” states their complaint. 

Another plaintiff, Una Gogic, filed a complaint arguing the Juul product they bought from a Circle K caused them to suffer from mood swings and suicidal thoughts. 

Gogic blames a subsequent suicide attempt on their use of their Juul device, according to the complaint, which includes claims the device led to chronic lung problems including asthma and bronchitis. 

Class Action Lawsuit Claims Juul Can Lead To ‘Cognitive Injuries’ 

Plaintiff Blake King, meanwhile, filed a complaint alleging his Juul device caused him to develop attention deficit disorder and led to other cognitive injuries including lack of concentration and trouble sleeping. 

Plaintiff Grace Mcauley-MacDonald also filed a complaint against Juul, in addition to its distributors, management, and e-liquid manufacturers, alleging claims of fraud, unjust enrichment, and breach of express warranty, among other things. 

King, Mcauley-MacDonald, the minor plaintiff, and Gogic are all seeking compensatory, treble, and punitive damages, along with medical monitoring to diagnose injuries caused by their usage of their Juul devices.

A class action lawsuit was filed against 7-11 in Florida earlier this month by consumers who claim the company falsely advertises and markets Juul e-cigarettes
