Bob's Discount Furniture Goof Proof warranty may not be goof proof.

A New York man has filed a class action lawsuit alleging Bob’s Discount Furniture fraudulently promotes its “Goof Proof” warranty to consumers.

Plaintiff Renal Glover says the Goof Proof warranty is marketed and sold to protect against furniture damage such as food and beverage stains, pen marks, tears, and punctures.

Glover claims the furniture’s “discount nature” creates added incentive for consumers to purchase the Goof Proof warranty, because they know less expensive furniture “may not be as sturdy or resistant to accidental stains or tears as higher priced furniture.”

However, the class action lawsuit states that Bob’s Discount Furniture collects premiums and then rejects claims submitted under the warranty.

The plaintiff says Guardian Insurance provides “undisclosed incentives or kickbacks” to Bob’s Discount Furniture for every Goof Proof warranty sold. In addition, sales employees can receive bonuses or, conversely, be penalized based on how many warranties they are or are not able to sell.

Glover alleges that consumers are misled through the defendant’s warranty sales “because the furniture is poorly made,” meaning the company “can more easily and unfairly attribute any accidental stain or rip to a product defect, when there might be cause for overlap between what caused the damage.”

When customers submit a claim under the Goof Proof warranty, it’s allegedly denied with the reasoning that the damage was not actually accidental but rather caused by misuse.

“Not noticing a stain or damage on the day it occurred is a common circumstance, especially if the furniture is used by other persons within a household and not exclusively by the warranty holder,” Glover’s complaint says.

The company also denies Goof Proof warranty claims in other situations, such as if there is more than one mark or puncture on the furniture; in those circumstances, the company allegedly chalks the damage up to misuse.

The company often categorizes rips or tears as “normal wear and tear” even if they are actually accidental damage supposedly covered by the Goof Proof warranty.

Additionally, Glover says the defendant hasn’t “reasonably defined” what types of damage are considered “excessive,” though it cites this reasoning when denying valid claims.

As a result of all this, Glover says the Goof Proof warranty’s value is “materially less” than the defendant represents.

Had he and others known the truth about the warranty, they either would not have purchased it or would have paid less.

Glover formally accuses Bob’s Discount Furniture of violating New York General Business Law and of breach of contract, fraud, unjust enrichment, and negligent representation.

He is seeking injunctive relief ordering the defendant to correct the alleged wrongdoing; restitution and disgorgement; monetary damages, including statutory damages; attorneys’ and experts’ fees; and any other relief deemed appropriate.

    Guardian has fixed my dresser drawer issue and now I have the same issue on my chest they say it is not covered. The repair on my dresser was a courtesy repair and not technically covered. They could not show me any documentation the dresser repair was a courtesy repair. I have only had the furniture from Bob’s for 2 years and it us falling apart. The track on the chest drawer has completely falling dowm to the next drawer, which is causing 2 drawers to not open and close properly. I filed a claim for my bed that they also denied. Thus furniture is poorly made and I wish i wouls have never purchased let alone purchased 5 year coverage plan that is useless.

    I accidently put a hot item on my 3 mth old outdoor dining set and was told Goof would not cover it…this was the reason I purchased this extra protection in the first place. I feel like Goof off purchase was a scam and really upset to be mislead. There should be a law against misleading the public and be honest with the customer.

    I put in a claim for a diaper leak, as bodily fluids from humans are covered. They denied it, stating odors are not covered. Makes no sense!! This is a scam.

    They added a 40$ policy without me approving it and I didn’t see it until it was too late. I let it go because it was a fairly small amount, but I wish I had said something now. I learned also, that they are a scam business and are out only to take advantage of people. Their furniture is terrible and their delivery promise was broken when they brought damaged merchandise and tried to hide it from me. They did not hold up their end of the bargain, yet won’t give a return or refund. They are predatory and their furniture is terrible. I will never buy anything from them ever again. They are dishonest and only want to take advantage of customers.

    I just filed a claim for my overpriced cheap furniture and awaiting their decision. I came across this because I found some of their questions weird. Only a reason to deny. I’ll keep you guys posted

    Goof proof is definitely a scam! Have tried to put in multiple claims in on both of my couch’s for rips in the backs
    Of the cushions. Went round and round. They told me the rips were not covered but a cigarette burn would be. Finally gave up and just covers overs of the couches.

    My recliner couch stopped working in November and I’ve been denied service and help by both Bobs and Goof proof after hours on the phone. They don’t cover anything despite us paying $399 for their scam insurance. They refuse to put any managers on the phone with me and I’m furious with how they are able to get away with this. They’ve probably gotten away with hundreds of thousands of dollars by scamming people who can’t afford to go hire a lawyer. It’s evil.

    Same!! Ive thrown away many of thier products for this same reason! Everytime a claim was put in I was denied ! I stopped bying after the last set of bed frames I brought they wouldn’t replace the broken frame when It was a clear manufacturer problem I sent pictures and they kept saying it was unclear so they denied it

    I’m going through the same thing keep being denied for claims saying it was misuse and salesperson said it covered any kind of accident charged me few hundred dollars and won’t stand behind the so called warranty good proof was sopossed to be 😩
