man dealing with annoying spam calls

If a car dealership has left you a ringless voicemail trying to get you to purchase Acura cars, this may be more than a simple annoyance—it could also be a violation of the TCPA, the federal law in place to protect against unwanted telemarketing communications.

Some car dealerships have been accused of using robocalls, unwanted texts and ringless voicemails to contact consumers in violation of the TCPA. If you have been hit with ringless voicemails from a dealership selling Acura cars, you may be able to take legal action.

The Telephone Consumer Protection Act

What exactly is the Telephone Consumer Protection Act? The TCPA is meant to protect consumers from unwanted telemarketing communications. Since its introduction back in 1991, nearly 30 years ago now, technology has advanced and telemarketers have developed new methods of contacting consumers.

These rules place restrictions on what kind of telemarketing methods can be used in what situations. As technologies have expanded, the TCPA has responded in kind, now including communications like spam texts, robocalls, prerecorded messages, and ringless voicemail.

What is Ringless Voicemail?

Ringless voicemail, sometimes referred to as a voicemail drop, is a method of calling popular with spammers (as well as debt collectors) in which a prerecorded message is placed in a person’s inbox without the phone ringing first.

At first, the Federal Communications Commission (FCC) was petitioned to have ringless voicemail exempt from robocall laws. However, this sparked controversy, and the petition was dropped in June 2017.

Why Am I Getting Ringless Voicemails About Acura Cars?

Some companies use illegal telemarketing practices to try and get consumers to buy their products or services. This is a convenient way for companies to reach many potential customers for a very low cost—in part because without a call actually being made, the company doesn’t incur any telephone-associated charges.

These ringless voicemails are intended to gain customers and seem less intrusive than other forms of telemarketing, but car dealership representatives violating the TCPA to sell Acura cars may not realize that this method of leaving voicemails without calling first may feel sneaky or underhanded, potentially even generating a sense of distrust.

You may be able to tell the company to take your number of their list, file a complaint with the FCC, or register your number with the National Do Not Call registry. Unfortunately, the registry is not a fool-proof method of preventing unwanted calls and texts, but it can help.

If you’ve been getting ringless voicemails about Acura cars, a car dealership may be ignoring TCPA rules in their attempt to get your business.

Unwanted Spam Call Statistics

Unwanted spam calls are becoming more and more of a problem, with Americans receiving about 58.5 billion robocalls in 2019, according to the robocall-blocking service YouMail. The number itself is not the only concerning thing—this also represents a 22% increase from the previous year, showing a rapid level of growth.

I was called from a Honda dealership asking me if I wanted to turn in my car for an evaluation, claiming a customer was looking for the exact model, year and color. I declined because it sounded like as if they wanted me to upgrade and buy a new car when in fact I just finished paying off the car. What a coincidence! They always want you to be debt with them.
