Bob's Discount Furniture Goof Proof warranty may not be goof proof.

A New York man has filed a class action lawsuit alleging Bob’s Discount Furniture fraudulently promotes its “Goof Proof” warranty to consumers.

Plaintiff Renal Glover says the Goof Proof warranty is marketed and sold to protect against furniture damage such as food and beverage stains, pen marks, tears, and punctures.

Glover claims the furniture’s “discount nature” creates added incentive for consumers to purchase the Goof Proof warranty, because they know less expensive furniture “may not be as sturdy or resistant to accidental stains or tears as higher priced furniture.”

However, the class action lawsuit states that Bob’s Discount Furniture collects premiums and then rejects claims submitted under the warranty.

The plaintiff says Guardian Insurance provides “undisclosed incentives or kickbacks” to Bob’s Discount Furniture for every Goof Proof warranty sold. In addition, sales employees can receive bonuses or, conversely, be penalized based on how many warranties they are or are not able to sell.

Glover alleges that consumers are misled through the defendant’s warranty sales “because the furniture is poorly made,” meaning the company “can more easily and unfairly attribute any accidental stain or rip to a product defect, when there might be cause for overlap between what caused the damage.”

When customers submit a claim under the Goof Proof warranty, it’s allegedly denied with the reasoning that the damage was not actually accidental but rather caused by misuse.

“Not noticing a stain or damage on the day it occurred is a common circumstance, especially if the furniture is used by other persons within a household and not exclusively by the warranty holder,” Glover’s complaint says.

The company also denies Goof Proof warranty claims in other situations, such as if there is more than one mark or puncture on the furniture; in those circumstances, the company allegedly chalks the damage up to misuse.

The company often categorizes rips or tears as “normal wear and tear” even if they are actually accidental damage supposedly covered by the Goof Proof warranty.

Additionally, Glover says the defendant hasn’t “reasonably defined” what types of damage are considered “excessive,” though it cites this reasoning when denying valid claims.

As a result of all this, Glover says the Goof Proof warranty’s value is “materially less” than the defendant represents.

Had he and others known the truth about the warranty, they either would not have purchased it or would have paid less.

Glover formally accuses Bob’s Discount Furniture of violating New York General Business Law and of breach of contract, fraud, unjust enrichment, and negligent representation.

He is seeking injunctive relief ordering the defendant to correct the alleged wrongdoing; restitution and disgorgement; monetary damages, including statutory damages; attorneys’ and experts’ fees; and any other relief deemed appropriate.

    I also have been denied from bobs furniture to repair a couch that had gotten a tear and the zipper broke and they refused to fix it and there was a stain on the couch and they wouldn’t help me with that either I am so sorry I spent the extra money for the goof proof and the guardian protection they were well over 100 dollars to fully protect the couch. Every time I call they come up with another excuse I am tired of calling them to be told it is not covered.

    My bed frame broke and my claim was denied with the reason that it was broken during normal use. This completely nonsense as the bedframe is not supposed to break with normal use in 3 years. Would like my case to be included in the class action.

    I have purchased bobs good proof warranty. Aug of 2020. On a sectional . I had my first of many claims submitted to there goof proof warranty company called Guardian . Everything was done online and pictures had to be submitted. I even filed each claim the minute each thing became broken or ripped . Both times I was denied any coverage. I received written notification that the damage was not covered . Which was completely wrong because my couch is falling apart and there is nothing I can do about it because I spent over 3,000 on it and I can’t afford a new one so I’m stuck with a broken 3,000 couch that was not covered under this so called goof proof that I was assured I would be covered for 5 years . It’s all lies . I feel lied to and cheated out of my money . They sell very cheap furniture.

    I was told i could purchase goof proof after my delivery if i decided. I purchased my daughter’s white bedroom set in July 2019. Salesman said i could call back and purchase goof proof. I called by Sept 2019 salesman took my card information over the phone. 300 or so dollars. Well I had been trying to access the goof proof and Guardian said Bob’s never forwarded my information to them. I went in person June 6. 2022 to the store with my receipt of sale for goof proof. Customer Service for Bob’s sentcme the copy andctold ne to talk to the manager at the store. Manager Ricky at Skokie store could see transaction i did purchase in Sept 2019. He offered to make it up to me and charged me an extra $100 to cover the rest of my furniture with goof proof. Said to contact Guardian in a week or so. I contacted Guardian and they said my goof proof was entirely canceled. I looked at my bank statement for June 2019, charge of $100 was taken June 6, 2022. I never was refunded any of my money. Now i have to return to the store again. No paint repair done on my daughter’s furniture. Its like a worthless piece of furniture now with the obvious stain on it.

    I am yet another victim of Guardian and Bob’s.Someone needs to shut them down.I purchased a sofa highly recommend by salesman,and he highly recommend Goof Proof,as additional coverage.One year later ,I hear a snap where seat cushion meets back cushion.Reported it to guardian,they replied I needed an overall pic of sofa. Did that! Now they say someone sat on top of back cushion,and denied the claim .I am 62 years old with R/A, they’ll say anything not to honor their contract.I want IN on the class action.
