UPDATE:
- This case was dismissed with prejudice Nov. 5, 2021.
Total Life Changes Raspberry Lemonade Flavor Iaso Tea Instant may come with an unwanted dose of tetrahydrocannabinol, or THC, the psychoactive component of marijuana, according to a class action lawsuit lodged in Georgia federal court Tuesday.
Lead plaintiff, Ashley Miller, who is a staff sergeant with the US Army, wants to represent other consumers she says were misled into thinking they were purchasing a THC-free flavor of Iaso tea from Total Life Changes, LLC. She claims that in addition to giving consumers a dose of an unwanted psychoactive ingredient, the product can lead to other consequences, such as a failed drug test.
Indeed, Miller claims that a Total Life representative, her friend’s sister, told her that the Raspberry Lemonade Flavor Iaso Tea Instant did not contain THC; however, Miller claims she ended up failing a random drug test at work after consuming the tea.
Miller says her employment was suspended pending an investigation into the failed drug test. She says she may now face anything from a demotion to an “other than honorable” discharge from the Army. Miller says that she has also been required to take substance abuse training and is barred from getting promotions, awards, and benefits as a service member pending the Army’s investigation.
Further, Miller says that she was also denied a promotion in rank that would have netted her a higher base salary due to the failed drug test.
After receiving news that she had failed the drug test, Miller says she had a sample of the tea analyzed by an independent lab. The lab found that the tea was probably not made from hemp as advertised, but from crops that contained THC and CBD.
Total Life Changes is a multilevel marketing company that sells supplements, essential oils, and skincare products. The company has been dinged by regulatory agencies for making false claims about treating COVID-19 and failing to properly label products, says Miller.
The Total Life Changes Tea class action lawsuit notes that the Raspberry Lemonade Flavor Iaso Tea Instant is labeled as containing “0.0% THC.” The company’s website also states that the Raspberry Lemonade Flavor Iaso Tea Instant is made from hemp extract “with 0% laboratory certified THC content.” Further, the THC content of other teas are noted on the company’s website and product packaging says the plaintiff.
The plaintiff says she is not the only consumer who has faced the loss of a job or other consequences due to the falsely labeled Total Life Changes Raspberry Lemonade Flavor Iaso Tea Instant. Consumers have complained to the Better Business Bureau. Total Life Changes is also facing legal action, including a parolee who filed a class action lawsuit claiming he faced incarceration from a failed drug test after drinking Total Life Changes detox tea.
Miller wants to represent other consumers in Georgia who purchased Total Life Changes Raspberry Lemonade Flavor Iaso Tea Instant within the past six years. She wants the company to pay damages and also a court order stopping the alleged mismarketing of the tea.
