Molson Coors Beverage Co. misleads consumers into believing its Topo Chico Ranch Water hard seltzer beverage contains tequila, a new class action lawsuit alleges.
Plaintiff Robert Younger claims Molson Coors misleads consumers by decorating packaging for its Topo Chico Ranch Water hard seltzer beverage with pictures of the agave plant and the statement “100% Agave & Real Lime Juice.”
Younger argues the only agave-based ingredient in the Topo Chico Ranch Water hard seltzer beverage, in reality, is agave syrup, a sweetener they claim is simply similar to sugar.
“Not only is ‘100% Agave’ misleading because it makes consumers expect a certain type of tequila, it is also deceptive because this type of agave ingredient is no different than added sugars, which are not a part of ranch water,” the Topo Chico class action states.
Younger wants to represent a Florida class and multistate consumer fraud class of individuals who have purchased the Topo Chico Ranch Water hard seltzer beverage during the statute of limitations for each cause of action alleged.
Molson Coors fails to expand on ‘alcohol’ its Topo Chico Ranch Water beverages contains, class action says
Younger argues consumers are further misled by the ingredients list for the Topo Chico Ranch Water hard seltzer beverage, which simply lists that the product contains “Alcohol,” without any additional context.
“Even if purchasers read the ingredient list, they will be misled because it lists only ‘Alcohol’ instead of truthfully identifying its source as not tequila from the agave plant but simple sugar, such as ‘Alcohol (from fermented sugar),’” the Topo Chico class action states.
Younger claims Molson Coors is guilty of fraud, negligent misrepresentation and unjust enrichment, and of violating the Magnuson Moss Warranty Act, various state consumer fraud acts and the Florida Deceptive and Unfair Trade Practices Act.
Plaintiff is demanding a jury trial and requesting injunctive relief along with an award of monetary, statutory, and/or punitive damages for himself and all class members.
A similar class action lawsuit filed against The Coca-Cola Co. over claims it deceptively labeled its Topo Chico hard seltzer beverages was dismissed by a New York federal judge earlier this month.
