Diageo North America misleadingly labels its Lone River brand “Ranch Water Original” hard seltzer product since it does not contain tequila, a new class action lawsuit alleges.
Plaintiff Scott Mao claims consumers expect a ranch water product to contain tequila, and that Lone River further misleads by using a sweetener in the form of agave nectar for its Ranch Water Original product.
Mao argues Lone River represents the beverage to consumers as if it “will be the same as when this drink was first sloshed into existence in ice-filled thermoses on the West Texas plains, containing tequila and lacking any sweeteners.”
The use of agave nectar as a sweetener also adds three grams of sugar to the beverage, which is “three more grams than ranch water described as ‘original’ is expected to have,” according to the Lone River class action.
Mao wants to represent an Illinois class and multi-state consumer fraud class of individuals who have purchased the Lone River Ranch Water Original hard seltzer product within the statutes of limitations.

Lone River also misleadingly represents its Ranch Water Original beverage by, among other things, including images of Texas, an agave plant, and two squiggly lines alluding to “the ‘worm’ people associate with tequila,” on the beverage, the Lone River class action alleges.
Mao claims Diageo is guilty of unjust enrichment and fraud, and of violating the Magnuson Moss Warranty Act, New York General Business Law, the Illinois Consumer Fraud and Deceptive Business Practices Act, and several state consumer fraud acts.
The plaintiff is demanding a jury trial and requesting an award of monetary, statutory, and/or punitive damages for himself and all class members.
Coca-Cola sought the dismissal of a similar class action lawsuit earlier this month that was filed by a consumer arguing it misleadingly labels its Topo-Chico brand ready-to-drink hard seltzer margarita products.
