Nestlé makes Coffee-mate branded creamers

An Illinois consumer says that Nestlé USA, Inc misrepresents the number of servings in its Coffee-mate branded creamers, coming up with only 107 teaspoons in a bottle of Caramel Latte Powdered Coffee Creamer that purported to contain 140 servings.  

Lead plaintiff Lurnia Ivory lodged the class action lawsuit in federal court Tuesday. She wants to represent other Illinois residents who allegedly paid for more creamer than they got when they purchased Coffee-mate.  

Ivory says that she purchased Coffee-mate creamers on several occasions. She says the bottle was boldly labeled as containing 140 servings. Each serving is four grams or approximately one teaspoon, says Ivory, but the bottles only contained two-thirds of what was promised.  

“Plaintiff sought to purchase products with a materially greater amount of powdered coffee creamer than was present – not in terms of ‘net weight’ but in terms of how much use she could expect from the product, conveyed by Defendant in ‘Servings’ prominently displayed at the neck of the Product,” explains the class action lawsuit. “Plaintiff did not expect one-third fewer servings.” 

Indeed, the plaintiff says that independent lab testing confirmed that Nestlé is short-changing those who purchase Coffee-mate creamers. Ivory contends that she and other plaintiffs would not have purchased or paid as much – more than $3.79 each – for Coffee-mate.  

The class action lawsuit accuses Nestlé of exploiting the trust consumers have in the Coffee-mate brand, one of the first powdered creamers to hit the market in 1970. The plaintiff points out that she and other consumers cannot be expected to determine that Coffee-mate creamer contains less than the promised 140 servings based on the net weight of the product.  

By misrepresenting the number of servings in Coffee-mate creamer, Nestlé violated Illinois consumer protection laws, and also committed fraud, negligent misrepresentation, breach of warranty, and unjust enrichment.  

Ivory wants to represent other Illinois consumers and obtain damages, including the premium they paid for the falsely advertised Coffee-mate, from Nestlé.

    I buy coffee mate every two weeks. The size is 35.3 oz. And when I open it it half full. I’ve ready got use to this creamer and I love it’s taste better than others. But the container is always half full. Ready I don’t know why they do this to their customers.
