Murad Class Action Lawsuit Overview:

  • Who: Two customers filed a lawsuit against cosmetics company Murad.
  • Why: The Murad class action lawsuit claims several Murad products contain color additives that are harmful when used around the eyes, despite lacking any such warnings.
  • Where: The class action lawsuit was filed in New York federal court.

Murad faces a class action lawsuit that alleges the cosmetic company conceals from customers that several of its skincare products contain color additives that are harmful when used around the eyes despite lacking any such warnings. In fact, Murad instructs consumers to use the product directly on or around the eyes in several cases.

The lead plaintiffs of the Murad class action lawsuit are Jessica DeCoursey and Grace Sit. DeCoursey experienced red and irritated eyes that developed discharge and began to swell and tear after using Murad Retinol Youth Renewal Eye Serum. She tried to call Murad to learn about the product’s ingredients but was “unable to reach an employee,” according to the complaint. DeCoursey also used Retinol Youth Renewal serum that made her eyes water.

Plaintiff Sit relied on the products’ labels and disclosures before buying Murad Retinol Youth Renewal Night Cream and Clarifying Oil-Free Water Gel.

“Nowhere on the labels did [Murad] disclose that the products should not be used in the eye area,” the class action says of both Sit’s and DeCoursey’s experiences. 

DeCoursey and Sit seek to represent a nationwide class of all persons who purchased one or more of Murad’s allegedly affected products for personal/household use within any applicable limitations period, as well as similar New York and Missouri state subclasses.

Murad Class Action Says FDA Prohibits Certain Color Additives in Eye Cosmetics

The products that allegedly contain the color additives include Retinol Youth Eye Serum, Retinol Youth Renewal Night Cream, Retinol Youth Renewal Serum, Nutrient-Charged Water Gel, Clarifying Water Gel and Hydrating Toner. The color additives that can be found are FD&C Red No. 4, D&C Red No. 33 and D&C Orange No. 4.

The United States Food and Drug Administration (FDA) prohibits the above color additives in cosmetics intended to be used around the eyes “unless specifically authorized for such use through regulations,” according to court documents. 

Murad “knew or should have known” that the products were unsafe for use in the eye area and has deliberately and willfully deceived consumers, the complaint says. 

Court documents also show examples of Murad competitors either not containing the harmful color additives or directing consumers to keep the product away from the eyes.

      I used the product faithfully until after my tear duct was removed. I had tearing irritation and then infection The Dr said I needed my tear duct removed. The dr said I will not have he infection anymore but it was coming back. Pus in he corner of my eye. I stopped using Murad and the infection went away.
