GM cadillac escaladeA class action lawsuit filed against General Motors claims that transmissions in Chevy and Cadillac vehicles possess a defect that cause them to jolt and shake violently.

The GM class action lawsuit was filed by Marisella Gutierrez, Jimmy Harman, Mark Kidd, and James Norvell who say they own GM vehicles that possess this problem, and have had to have repairs done under warranty.

However, the four vehicle owners fear that their warranty will no longer cover repairs for the problem.

The GM transmission class action lawsuit claims that certain Cadillac and Chevy vehicles are fitted with a Hydra-Matic 8L90 or 8L45 transmission that cause them to jolt, lurch, and jerk while being driven.

The Chevy, Cadillac class action lawsuit goes on to say that the allegedly defective transmissions not only cause an unpleasant driving experience, but cause the vehicles to fail to accelerate, fail to downshift, and delay stopping even if the brakes are applied.

The GM class action lawsuit claims that these problems pose serious dangers because they can prevent the drivers from being able to operate their vehicles effectively, which can lead to a collision or an unsafe driving condition.

Allegedly, this problem is caused because of a range of internal problems in the transmissions, including defective torque converters. The plaintiffs state that there is too much friction between the transmission component parts, which results in metal shavings coming off from the elements.

These metal shavings allegedly then circulate throughout the transmissions’ hydraulic systems, causing further damage to the transmission’s hydraulic systems.

The drivers say GM has been aware of this defect for years, and has failed to adequately address the issue. According to the customers, the company has even tried to convince customers that the problems were normal, including the dramatic “surging” or “unexpected acceleration” that are characteristics of the defect.

The Chevy, Cadillac transmissions class action lawsuit states that customers were financially injured by the transmission defect and by GM’s denial of it. Allegedly, had customers been aware of the defect before they purchased or leased their vehicles, they would not have purchased them or would not have paid as much as they did for it.

The consumers argue that GM is aware of or should have been aware of the defect, noting that numerous trade publications criticized the transmissions problem. Despite this criticism, GM has reportedly never truly fixed the problem, and continues to make money from the sale of the vehicles while consumers continue to be financially injured and be put at risk physically.

Allegedly, GM has not attempted to remedy the problem in a widespread way, and has only offered solutions like patchwork software updates, parts replacements, and other insufficient fixes.

The GM drivers are represented by Lynn Lincoln Sarko, Gretchen Freeman Cappio, Tana Lin, Ryan McDevitt, and Max Goins of Keller Rohrback LLP.

    I have a 2016 Cadillac Escalade with a little over 110,000 miles that I am having the lifter problems with and of course my extended warranty just expired at 100,000 miles How do I got about becoming a part of the class action lawsuit that has been filed?

    2019 GMC acadia, slipping and banging into gear. Started at 7500 miles, told this was normal, now have 98000 miles and it is slipping more. How do i get into the class actions suit?

    How do you get involved with these lawsuit being I have a 2017 tahoe with the p0796 code and the transmission is out with 77,000 miles. I also a year ago had to replace the transmission in my 2014 silverado 1500 for the same exact thing. Plus they both have the junk AFM system on them. Would like to see gm pay for having to spend nearly $13000 to have the transmissions replaced.

    2016 Tahoe LTZ same problem here also one of the motor mounts where Broke. I bought the car from the dealership only made 1 payment on car and here comes at 8000 bill. The car had these problems before buying it. The car was 43,000. They shouldn’t of been able to sell the car like this.

    2015 Escalade 95,120 miles just had transmission serviced with many different noises, clangs and clunks, cost me out of my pocket to service June 2021

    Does anyone know what the status is on this case? I have a Chevy Impala and it’s been doing what I call a slip-bang for a couple years now. When I come to a stop and then step on the case to go, it hesitates, then slams into drive. Have there been any updates on this?

    I have a 2019 Cadillac Escalade and it is having the same problem. It is had problem for some time. Doesn’t want to speed up, pops and sometimes won’t shift to speed up. If this is still going on please let me know how to get involved.

    Have a 2016 Silverado. What a nightmare. Only owned for little over a year, brought it with 48k miles on it. At 68k had collapsed lifter on #7 exhaust valve, which wiped out the lobe on camshaft. $5,400.00 for repair at the dealer Ourisman Chevrolet of Alexandria. Work was done in the winter time so I hadn’t tried my A/C which was working perfectly fine since I brought it. Summer months come and I turn my a/c on warm air. I call them back and immediately the service representative says those trucks are known for condensers to leak. Well to replace Camshaft and lifters all that front end had to come off the truck, that would include the condenser coil. I happened to look under the hood, they left both service caps off for suction and discharge lines for a/c system. They left all the grommets out that fasten the inner shroud under the hood to access the radiator and condenser. Later I thought to myself, they left them out because they knew I would be back because the condenser or something up in that area is infact leaking, but was not before they did the work. Took it back to them for regular service and mentioned the above to service rep, and told them I want everything put back like it was. Sorry for being long winded but, your whole reasoning for going to the dealer is you have the confidence the job will be done right. Now my transmission is going, like I see mentioned in this form, same symptoms and got the same diagnosis from a reputable transmission shop torque converters aren’t shxt. I knew I should’ve got a Ford. Chevrolet/GMC are crooks, they don’t own up to anything. They will never touch the truck again not even for service.

    I have a 2015 Chevy Tahoe with 112,000 transmission with out.. I was told the torque converter and more was messed… How can I get information on get in the lawsuit?

    This issue happened to us a few years ago to our 2012 Cadillac ESV. We had to replace the transmission, the mileage was only around 100k. Are there any lawsuits that would include this year ESV’s also? Sounds like this issue has effect alot more models.
