GM cadillac escaladeA class action lawsuit filed against General Motors claims that transmissions in Chevy and Cadillac vehicles possess a defect that cause them to jolt and shake violently.

The GM class action lawsuit was filed by Marisella Gutierrez, Jimmy Harman, Mark Kidd, and James Norvell who say they own GM vehicles that possess this problem, and have had to have repairs done under warranty.

However, the four vehicle owners fear that their warranty will no longer cover repairs for the problem.

The GM transmission class action lawsuit claims that certain Cadillac and Chevy vehicles are fitted with a Hydra-Matic 8L90 or 8L45 transmission that cause them to jolt, lurch, and jerk while being driven.

The Chevy, Cadillac class action lawsuit goes on to say that the allegedly defective transmissions not only cause an unpleasant driving experience, but cause the vehicles to fail to accelerate, fail to downshift, and delay stopping even if the brakes are applied.

The GM class action lawsuit claims that these problems pose serious dangers because they can prevent the drivers from being able to operate their vehicles effectively, which can lead to a collision or an unsafe driving condition.

Allegedly, this problem is caused because of a range of internal problems in the transmissions, including defective torque converters. The plaintiffs state that there is too much friction between the transmission component parts, which results in metal shavings coming off from the elements.

These metal shavings allegedly then circulate throughout the transmissions’ hydraulic systems, causing further damage to the transmission’s hydraulic systems.

The drivers say GM has been aware of this defect for years, and has failed to adequately address the issue. According to the customers, the company has even tried to convince customers that the problems were normal, including the dramatic “surging” or “unexpected acceleration” that are characteristics of the defect.

The Chevy, Cadillac transmissions class action lawsuit states that customers were financially injured by the transmission defect and by GM’s denial of it. Allegedly, had customers been aware of the defect before they purchased or leased their vehicles, they would not have purchased them or would not have paid as much as they did for it.

The consumers argue that GM is aware of or should have been aware of the defect, noting that numerous trade publications criticized the transmissions problem. Despite this criticism, GM has reportedly never truly fixed the problem, and continues to make money from the sale of the vehicles while consumers continue to be financially injured and be put at risk physically.

Allegedly, GM has not attempted to remedy the problem in a widespread way, and has only offered solutions like patchwork software updates, parts replacements, and other insufficient fixes.

The GM drivers are represented by Lynn Lincoln Sarko, Gretchen Freeman Cappio, Tana Lin, Ryan McDevitt, and Max Goins of Keller Rohrback LLP.

The GM Chevy Cadillac Transmission Defect Class Action Lawsuit is Marisella Gutierrez, et al. v. General Motors LLC, Case No. 2:19-cv-12371-GCS-SDD, in the U.S. District Court for the Eastern District of Michigan.

I have a 2011 Chevy equinox that not only burned oil excessively but also had a transmission defect. It would surge/jump and or die when accelerating onto the highway – very dangerous. I had the engine and transmission rebuilt and have all the records. I never received anything in the mail but am sure I should be part of several class action lawsuits. The only problem I forsee is that it was purchased under my Brother In Laws name for the GM family discount. It was transferred to my name and we paid all the sales tax, etc. and had it changed to my name. How do I find out if GM just had the wrong name on the lawsuits? 2018 Yukon, has gone into a “gear limbo/coma” 4x. The last 3 I could feel the truck shake and slip when i changed gears. Then within a few 100 miles it goes into this”coma mode” where it doesn’t recognize if it’s in P,D,R,N,or L. When this happens it takes forever to take off, it doesn’t recognize when it’s parked so you can’t shut engine off and. Check engine comes on with bs and the shop has replaced everything but it keeps happening. It’s a mess!! Please add me as well!

Just bought a used 2017 GMC Sierra 1500. After I purchased it from a GM dealer I noticed the downshifting was very hard it seemed to hunt for shifts. Very disappointed and wondering what’s going to happen next. I wish GM would address this problem as I was told by the salesman that there customer service was second to none.

I own a 2018 Chevy Silverado 1500 4×4 4 door LT and I’m having major problems with up-shifts, down-shifts and at one point this Possessed beast ran wide open with highway speeds that would land you in jail if caught! After at least a dozen taps of the brake pedal and even canceling the cruise button it still ran wide open for at lease a mile before returning to its normal malfunctioning . Imagine this same road rocket spring along the interstate with a lesser experienced driver behind the wheel and the results would be catastrophic! So here I sit as many of you when they have contacted their Chevy dealer and hearing the same old shit. Why we haven’t heard of this problem before, it’s all new, first time I’ve heard of such, well trust my on this, because I’ve experienced it first hand while wide awake in the middle of the day. This truck drove out of control and all by its self. And the shifting along with lugging and shuttering are an all time Sucks!

  9. Robert Maldonado says:

My 2016 GMC Yukon Denali’s transmission shifts very rough.

  10. Jacob Vogan says:

Please add me. I bought a brand new 2018 GMC Sierra. It had a very clunky shifting transmission right from the night I was driving it home from the dealership. It also had what is known as the Chevy shake. After reading all the forums I realized these were long term problems that the dealerships were not able to fix. I traded the truck in with just 4,500 miles on it and lost $8, 800. I’m still paying on that money.
