GM cadillac escaladeA class action lawsuit filed against General Motors claims that transmissions in Chevy and Cadillac vehicles possess a defect that cause them to jolt and shake violently.

The GM class action lawsuit was filed by Marisella Gutierrez, Jimmy Harman, Mark Kidd, and James Norvell who say they own GM vehicles that possess this problem, and have had to have repairs done under warranty.

However, the four vehicle owners fear that their warranty will no longer cover repairs for the problem.

The GM transmission class action lawsuit claims that certain Cadillac and Chevy vehicles are fitted with a Hydra-Matic 8L90 or 8L45 transmission that cause them to jolt, lurch, and jerk while being driven.

The Chevy, Cadillac class action lawsuit goes on to say that the allegedly defective transmissions not only cause an unpleasant driving experience, but cause the vehicles to fail to accelerate, fail to downshift, and delay stopping even if the brakes are applied.

The GM class action lawsuit claims that these problems pose serious dangers because they can prevent the drivers from being able to operate their vehicles effectively, which can lead to a collision or an unsafe driving condition.

Allegedly, this problem is caused because of a range of internal problems in the transmissions, including defective torque converters. The plaintiffs state that there is too much friction between the transmission component parts, which results in metal shavings coming off from the elements.

These metal shavings allegedly then circulate throughout the transmissions’ hydraulic systems, causing further damage to the transmission’s hydraulic systems.

The drivers say GM has been aware of this defect for years, and has failed to adequately address the issue. According to the customers, the company has even tried to convince customers that the problems were normal, including the dramatic “surging” or “unexpected acceleration” that are characteristics of the defect.

The Chevy, Cadillac transmissions class action lawsuit states that customers were financially injured by the transmission defect and by GM’s denial of it. Allegedly, had customers been aware of the defect before they purchased or leased their vehicles, they would not have purchased them or would not have paid as much as they did for it.

The consumers argue that GM is aware of or should have been aware of the defect, noting that numerous trade publications criticized the transmissions problem. Despite this criticism, GM has reportedly never truly fixed the problem, and continues to make money from the sale of the vehicles while consumers continue to be financially injured and be put at risk physically.

Allegedly, GM has not attempted to remedy the problem in a widespread way, and has only offered solutions like patchwork software updates, parts replacements, and other insufficient fixes.

The GM drivers are represented by Lynn Lincoln Sarko, Gretchen Freeman Cappio, Tana Lin, Ryan McDevitt, and Max Goins of Keller Rohrback LLP.

    I have a 2016 Silverado and transmission went I have a qoute of $4500. To fix I even paid for extended warranty but I missed it buy under a 100 miles I always liked chevy trucks but this is definitely changing my mind on buying another or recommending someone to buy this should definitely be a recall issue especially with how much you pay for the vehicle.

    We have a 2016 Chevy Tahoe. It is the only vehicle that we have so it has 165,000 miles on it. We purchased the Tahoe new and have always taken it to the dealer to have the service done as it should be.We just spent almost $6000 on a new transmission because they said the torque converter was not working at all the tranny lines were leaking terrible and was not sure what else they would find once they got inside the transmission because of the slippage. It has only been a couple weeks since replacing the tranny now suddenly the check engine light is on, the traction control light is on, and the oil pressure is slightly elevated compared to where it usually runs. I understand our Tahoe may have more miles than some 2016‘s do but they are highway miles and regular services and is very well taken care of so it should last longer than what it has. I do not know what the solution is but cannot afford to put money into repairs constantly with the kind of payment that we have due to the fact that we traded the last Tahoe within five months of getting it because it was having so many issues. So now the overhead from the previously traded Tahoe and now the expense of a transmission and have no idea what the shop is going to tell me next week for the issues that have suddenly arisen. I do not know if the lawsuit towards GM is still open but if so please add us to the list of people that have completely got screwed over by this problem not being fixed.

    Add me to lawsuit 2018 silverado going down interstate and it felt like it went into n about killed my wife and i truck slowed down like not in gear doing 70 this is not what you want only 70000 miles on it shop looking at est $3500.00

    I have a 2017 Tahoe with 79,000 miles on it. Not under warranty anymore. Transmission has to be replaced for $8000-9000. Went into neutral on freeway and then shut down. Service says torque all messed up inside. Please add me to the lawsuit!

      My Wife had the same issue driving down the interstate in Birmingham, AL. A few days before, she indicated there was a hard shift going up hill at highway speed. Less than a week latter, the transmission completely failed. She luckily made it to the shoulder safely. If you receive an ODB2 Code of 0796… “Transmission Pressure Control Solenoid “C”. The purpose of the Transmission Pressure Control Solenoids is to control the pressure of the fluid for the proper operation of an automatic transmission.” Without pressure in the tranny, you will see burnt tranny fluid and failure in the planetary gear, causing completed loss of power. I have been a Chevy fan my whole life, and own a 67 Camaro, 2017 Tahoe, and 2021 Trail Boss. I am now rethinking that as Chevy does not stand behind their product and replace known defective parts. Same thing happened when my AC went out on my 2017 Tahoe. The local dealer service center indicated GM knew about the product defect and did not recall the part for replacement, forcing me to again pay for Chevy’s incompetence and neglect.
      Good luck for those that own a Chevy.

    I purchased a 2015 Silverado last year on my first service change they mentioned a transmission problem and flushed it out for me at no charge but It didn’t resolve the problem and I think my warrantee is now up also so I’d like to be added to the list for the class action lawsuit

    we have a 2015 chev suburban LT, 128,000 mileage. transmission needs to be replaced. That is ridiculous. What do we need to do to be added to the class action law suit?
