FCA Ram defect class action lawsuit overview: 

  • Who: James Neu filed a class action lawsuit against FCA US LLC and Stellantis N.V. 
  • Why: Neu claims FCA and Stellantis manufactured and sold model year 2017-2018 Ram 2500 and Ram 3500 pickup trucks containing allegedly defective hydraulic control units and antilock braking systems.
  • Where: The class action lawsuit was filed in California federal court.

FCA US and Stellantis manufactured and sold model year 2017-2018 Ram 2500 and Ram 3500 pickup trucks containing “dangerous and defective” hydraulic control units and antilock braking systems, a new class action lawsuit alleges. 

Plaintiff James Neu claims the alleged defects cause the Ram vehicles’ hydraulic control units and antilock braking systems to become inoperable and makes them more difficult for drivers to control. 

“Driving the Vehicles become especially dangerous in already dangerous road conditions, such as when the road is wet or snowy, as braking becomes much more difficult,” the FCA class action states. 

Neu argues FCA and Stellantis either knew or should have known about the alleged defects prior to selling the Ram vehicles to consumers, as evidenced by a Technical Service Bulletin allegedly regarding the defects. 

“Defendants perform rigorous pre-sale testing and received numerous consumer complaints relating to the Defect,” the FCA class action states. 

FCA, Stellantis violated federal and state laws, class action says

Neu wants to represent a nationwide class and California subclass of consumers who own, owned, lease or leased a model year 2017-2018 Ram 2500 and/or Ram 3500 pickup truck that was purchased in the U.S. or its territories. 

FCA and Stellantis are accused of unjust enrichment, fraud and breach of implied warranty of merchantability, and of violating California’s False Advertising Law, Consumers Legal Remedies Act, and the Magnuson Moss Warranty Act, among other things. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and other damages for himself and all class members. 

A separate class action lawsuit was filed against FCA in June by a consumer arguing the automaker concealed an alleged defect that allowed water to enter into the back cabin of its Ram 1500 pickup trucks.

    2018 Ram 3500 Dually, same problem. No relief in site. FCA should replace at no cost due to aggravation of the constant “dinging” while the system is jacked up and the cruise control doesn’t work.

    HCU unit being replaced on my 2018 Ram 2500 this Friday 3/1/2024. Bad enough there’s not a recall on this yet. Bought this truck new on 2019 with 100k/7year factory extended warranty that DOES NOT COVER THIS PART!
    What a crock!

    In case you are not aware, the four wheel drive system will not engage after the “Service Electronic Braking System” warning. We live in snow country and in addition to the danger of no ABS or STC, we cant use 4WD so the truck is useless in inclement weather. Latest weekly Ram Cares call states the module may be available in June. I hope the lawsuit includes payment for lost use/business cost. For us thousands as we haul horses with it and can’t do so without the 4WD function working least we get stuck. No snow plowing either without 4WD.

    We have a 2016 RAM 1500 and it’s done the exact same thing. The ABS module threw a code and now you can’t get the part anywhere. It also kept telling us the Antilock Breaks were going out. We keep getting the run around on a otherwise perfectly good truck. Make it make sense.

    I have 2017 RAM 2500 with a current Mopar warranty. Even with that I am unable to get this ABS/traction control/cruise control issue resolved and have been waiting for maybe six months or more. I am honestly afraid about driving this truck in rainy or snowy weather. When I bought a RAM I didn’t expect that to indicate a possibility of RAMming into something due to a braking and traction control issue.

    I am talking to Ram now as i am having the same issues with my 2017 Ram 2500. They said its out of warranty so nothing they can do on their end to good will it. They also said that they are not aware of this being a common problem so again will not help. They told me I had to bring it to a Ram dealership to have it diagnosed in order to help me. I told them i already had the codes. They said they cannot help me unless a ram dealer hooks it up to the computerm said fine ill do it since you’re willing to help me. After all of that they are now saying to bad on your own and only replacing the pump and not the module as well. Ram is a disappointment.

    Mine has gone out as well on my 2017 Ram PowerWagon. Both Antilock Braking System Module and HCU. I have had them replaced once at Jacksonville (FL) Chrysler for $2500. Now they can’t get the parts anymore. Even the dealer knows about this lawsuit and about the chronic failure in these parts. Don’t forget to mention, it disables your cruise control as well as your traction control. Good luck sewing Stellantis. My bet is this is just collateral damage for them and they’re just hoping this problem goes away of the years as their is less and less 2017-2018 2500/3500 trucks on the road. They’ll pay the settlement in the lawsuit and just write it off and move on.

    Additionally my ABS issue started at 16k miles. The vehicle now has 18k miles

      I am having the same issue it has been replaced twice and is out again for the third time and now the parts are not available to fix it
