Porsche emissions may have been misrepresented.

A new class action lawsuit over Porsche emissions claims the company manipulated and deceived consumers about the performance of its cars.

Luigi Sciabarrasi of California says he paid about $90,000 for a new Porsche Panamera in June 2011 after researching the automotive market and comparing the features and performance — including emissions and fuel efficiency — of several makes and models. Since then, he learned the automaker provided fraudulent data about the Porsche emissions, data that helped convince him to buy the Porsche.

The company’s deceitful practices cost Sciabarrasi — literally, he says — and now he wants compensation.

Sciabarrasi filed a class action lawsuit against Porsche on Jan. 8 in federal court in California. He is accusing the car company of committing fraud and unjust enrichment and claims its intentional campaign to conceal the true Porsche emissions output violated California’s unfair competition law, the Consumers Legal Remedy Act, false advertising law and emissions warranty law.

The plaintiff is seeking the court’s certification of the case as a class action lawsuit and wants to represent both a nationwide and a California class of consumers who, he says, were defrauded by Porsche. According to his class action lawsuit, there are likely at least tens of thousands of potential Class Members.

The class vehicles cited in the allegations include model year 2009 through 2016 Panamera and 911 cars.

Porsche emissions may have been misrepresented.“In the face of increasing environmental regulation aimed at reducing the detrimental effects of noxious exhaust pollutants and harmful greenhouse gases, Porsche followed Volkswagen and Audi’s lead in deceiving regulators and the public regarding the quality and characteristics of the Class Vehicles,” the Sciabarrasi class action lawsuit says. “Although Porsche continues to conceal the full nature and extent of its wrongdoing, early reporting indicates that Porsche engaged in a pattern of multi-faceted deception.”

According to the class action lawsuit, Porsche manipulated the drivetrain of the individual vehicles submitted for emissions testing to produce higher fuel efficiency and emissions ratings.

The company also allegedly installed a “defeat device” that would respond to testing in such a way as to trigger compliance with the emissions standards and lied to regulators about the cars’ compliance in all of their driving modes, Sciabarrasi claims.

The class action lawsuit is at least the third to be filed over Porsche emissions in recent months.

In October, two other class action lawsuits were filed by Porsche owners, also in federal court in California. The plaintiffs in those cases argue, like Sciabarrasi, that their cars have higher emissions and use more fuel than they were advertised to, which has created financial problems for them.

Separately, a $9 million-plus class action settlement has been reached in Canada over Bosch emissions defeat devices allegedly used in Porsche, Volkswagen and Audi vehicles.

    My 2012 Panamera 4 engine caught on fire while I was on the highway dec 24,2020. Still don’t know what happened. Is there anything I can do?

    I own a 2009 Porsche 911 Carrera S
    Can I be included in this lawsuit?
    The value I think it’s worth vs the depreciated value now that this vehicle has a cloud over it makes it hard to sell at what I expected to sell it for
