Toyota priusToyota can’t escape a class action lawsuit alleging certain models of its popular Prius hybrid vehicles contain a defect that causes them to stall.

The plaintiffs contend that Toyota knew of the defect because it had manifest in earlier 2005 models; however, Toyota argues that it was a different defect that caused stalling in the 2010 through 2014 Priuses.

The Toyota Prius engine defect class action lawsuit was trimmed of fraud-based claims, the express warranty claim, and the negligent misrepresentation claim in September 2018. The plaintiffs were allowed a chance to amend their complaint.

U.S. District Court Judge Josephine L. Staton disagreed with Toyota’s argument to dismiss the plaintiffs’ amended complaint, finding that the question remained for later stages of the litigation in the class action lawsuit.

“The court is not persuaded by Toyota’s arguments,” stated the judge in the order. “Whether the true cause of the defect was the lead soldering is a factual issue the court cannot resolve at this stage.”

Despite rejecting Toyota’s argument about the cause of the defect, Judge Staton cut some the claims in the Toyota Prius engine defect class action lawsuit. Specifically, the plaintiffs alleged that a software update issued in response to a recall made the problem worse.

“[The Plaintiffs] have failed to allege that Toyota intentionally and without authorization interfered with Plaintiffs’ possession of their vehicles,” concluded the court order.

According to the Toyota Prius class action lawsuit, 2010 through 2014 Priuses are affected by an inverter defect. The defect allegedly causes the hybrids to overheat.

The vehicles then enter into a so-called “fail-safe” mode. In that mode, the vehicles slow down, and, according to the plaintiffs, even stall.

The plaintiffs contend that Toyota is aware of the defect because of a similar problem in 2005 model-year Priuses.

Despite knowing of the issue, Toyota exacerbated the problem by increasing the voltage of certain models, just as it did in 2005, according to the Toyota Prius class action lawsuit.

Further, contends the Toyota Prius engine defect class action lawsuit, the car maker instituted a recall that failed to solve the problem in 2014 and 2015.

The sudden slow downs of the affected Priuses pose a serious safety concern to all motorists on the road, alleged the Toyota engine defect class action lawsuit.

In fact, the plaintiffs claim that the problem can cause collisions that can lead to death, but Toyota failed to warn owners, lessees, and consumers about the problem.

    2011 Pruis TOTAL DISAPPOINTMENT! :(
    Bought it at a Toyota Dealership and the ‘Low Oil Pressure’ Wordage comes up on the screen, so I brought it in to Toyota for service. (Faithful customer for 5 Years for Service for this car.)
    They said it had no oil in it!!! They added oil … And I was told I could keep driving it & to just keep an eye on the oil level OR. get it fixed for $2,800 + tax and then drive it for 1,300 miles to ‘see what happens’. They said: “the ‘rings around the pistons may have to done, which will cost over $2,000. Sorry to read all the REALLY BAD situations some people have experienced with these cars. I hope there will be some justice done.

    My 2011 Prius has stalled twice once in 2015 all the dash lights came on it said check hybrid system toyota kept the car 2 months to repair it. Now in 2020 it stalled again on the freeway and burst into flames. I am now independently sueing toyota under the lemon law. Please Add me to the class action.

    Hi: We had the same problem with a 2009 Prius–the engine stalling–and the 2009 model wasn’t on any recall list. But it had the exact same defective problem and it got so bad I had to trade it in long before I wanted to. I feel I deserve compensaton. How do I get added to this class action lawsuit?

      Please add me …prius stalling, inverter changed now they are saying it might be the battery but there is a year shortage for that…which is a lie. Please help i am getting screwed out of my Toyota powertrain warranty by this fiasco.

    My Prius stalled out last year while I was driving on the interstate in the rain. It started to smoke and made a very loud noise immediately. It was a very dangerous situation with my toddler in the car. I had to leave my vehicle at a welcome center and had it towed. Car never recovered. How do I go about being added to the suit?

      I drive through a puddle, traction light came in, then oil pressure, then the fail-safe message and lastly, the engine light came on. This is some crazy $#!+. I have never heard of a car going crazy like that after driving through a puddle. My mechanic told me that the head gasket blew up and hit the wall of my engine. There is now a hole and cracks on the side of my engine. Most insurance companies don’t cover mechanical issues, the car lot i bought it from is ignoring my calls and texts, i can’t trade it in coz no place would want a skeleton. I’m f***ed TOYOTA! What can you do to help me? Pls pls pls.
