interior of a Hyundai Tucson vehicle with a view of the sunroofHyundai owners involved in a class action lawsuit over an alleged shattering sunroof defect say they have reached a settlement that would provide several options to Hyundai drivers including a trade-in and cash.

Under the terms of the proposed Hyundai class action settlement, Class Members may trade their vehicle in for a Hyundai without a sunroof, and claim an additional $1,000.

Those who decide to sell their Hyundai and replace it with a non-Hyundai vehicle, can claim up to $600.

The Hyundai sunroof class action settlement also provides $200 for any Class Member who experienced the shattering defect directly. In addition, all Hyundai vehicle owners will be warned of the shattering sunroof defect through the settlement.

Plaintiff Bill Glenn alleged in his class action lawsuit that the panoramic sunroofs in certain Hyundai vehicles were prone to shattering.

Glenn claimed that he and other Hyundai drivers were not warned about the defect affecting the Hyundai Veloster Sonata, Tucson, Sante Fe, Sante Fe Sport, and Elantra GT.

The Hyundai shattering sunroof class action lawsuit came after several car manufacturers recalled vehicles for reported defects in the panoramic roofs, including the 2012 and 2013 Hyundai Veloster.

The plaintiff claimed that the sunroof in his 2014 Santa Fe Sport spontaneously shattered six months after purchase.

Under the Hyundai class action settlement, Class Members may also be able to obtain reimbursement for money they spent repairing the problem, including fixing damage to car interiors, upholstery, and paint.

Hyundai has also agreed to pay consumers who had to rent a car while their affected vehicle was being repaired.

“Without requiring further delay and expense to litigate each of these disputed issues, the proposed settlement is instead poised to deliver meaningful relief to the class right away,” notes the proposed Hyundai class action settlement agreement. “The settlement largely shifts the expenses related to a shattered panoramic sunroof away from individual class members and onto Hyundai.”

In addition to monetary relief, Hyundai has also agreed to double the length of the sunroof warranty to 10 years. Further, going forward, even if the car makers thinks that road debris caused damage to a Hyundai with a shattering sunroof, they will repair the affected vehicle for free.

“Class Counsel, having spoken with many class members over the past few years and having previously resolved other automotive defect class actions, believe this settlement provides strong relief to the class and is worthy of the Court’s approval,” says the plaintiff’s motion for approval of the Hyundai class action settlement.

After launching the Hyundai shattering sunroof class action lawsuit in 2015, the plaintiff faced a motion to dismiss. While the class action survived total dismissal, claims under California consumer protection law and unjust enrichment were trimmed by U.S. District Judge David O. Carter.
