  • Mercedes-Benz must face class action claims that its 2015-2019 C-Class vehicles suffer from a manufacturing defect that causes raw fuel to leak within the engine compartment, endangering drivers, a Georgia federal judge ruled.
  • On Nov. 1, U.S. District Judge William M. Ray II issued an order denying Mercedes-Benz’ motion to dismiss the class action lawsuit, which drivers refiled after mediation failed.
  • The automaker argued that the drivers’ claims should be dismissed because it extended the warranty program for the 2015 to 2019 Mercedes W205 vehicles and C300 models. 
  • But Judge Ray said the drivers do not simply seek reimbursement for the repairs but also damages to reflect the diminished value of the vehicles.

Consumers who say that 2015-2019 Mercedes-Benz C-Class vehicles, including its popular C300 models, suffer from a manufacturing defect that causes raw fuel to leak within the engine compartment, endangering drivers, are heading to mediation under a new ruling by a federal judge in the class action lawsuit. 

U.S. District Judge William M. Ray II issued a six-month stay on the Mercedes-Benz C-Class class action lawsuit. Judge Ray encouraged the plaintiffs and the automaker to try to work out the allegations in mediation, pointing out that Mercedes-Benz extended warranty coverage to the leaky fuel pump defect alleged in the lawsuit.

Lead plaintiffs Nicholas Rosen, Tamer Nassar, and Reginald St. Jean claimed in a class action lawsuit filed in February that Mercedes-Benz is aware of the defect and intentionally conceals it from consumers. 

Rosen, Nassar, and St. Jean want to represent a Nationwide Class of current or former owners of 2015-2019 Mercedes-Benz C-Class vehicles. 

The Mercedes-Benz vehicles’ propensity to leak fuel can lead to dangerous situations including the inhalation of fumes, vehicle stalling, and vehicle fire, according to the class action lawsuit. Plaintiffs claim Mercedes-Benz is “unable or unwilling” to repair the C-Class vehicles, often telling consumers the repair of fuel system components is not covered under warranty. 

This refusal includes towards drivers who have new vehicle warranties and certified pre-owned warranties, which cover 48 months or 50,000 miles and 60 months with unlimited mileage from the in-service date, respectively, say plaintiffs.

“Mercedes-Benz has done nothing to address or correct the Fuel Leak Defect when it manifests in the Class Vehicles,” states the class action lawsuit. “Instead, Mercedes-Benz has denied their requests to provide a repair under warranty and instead forced Class members to pay out of pocket.” 

Plaintiffs claim they and Class Members would not have chosen to purchase the vehicles or paid substantially less for them if they had known about the defect.

Rosen, Nassar, and St. Jean allege Mercedes-Benz violated California’s Consumer Legal Remedies Act, the California Business & Professions Code § 17200, the Connecticut Unfair Trade Practices Act, the New Jersey Consumer Fraud Act, the Georgia Fair Business Practices Act, and the Georgia Uniform Deceptive Trade Practices Act

The plaintiffs are seeking actual, general, special, incidental, statutory, punitive, and consequential damages for themselves and Class Members. 

Although the automaker received a temporary reprieve in this case, Mercedes-Benz was part of a nationwide recall this month involving multiple car manufacturers  after it found some vehicles had problems with their child restraint systems

    The smell of gas in getting worse. Horrible in the morning with the kids in there. It almost smells as if we have it inside of the car. 2016 c300 4matic

    I have a 2016 Mercedes C 300 which is smelling like gas inside the car when I drive. Mercedes fixed it for free today. Not sure if it’s a temporary fix.

    Mercedes doesn’t have a recall. They only have campaigns. Voluntary recall campaigns, that Mercedes sent out 63 letters to prove that they do their best. For the rest of uninvited Mercedes owners? If you are not sure about your car or you have similar issues, you can go to Mercedes dealer so they can tell you that “yes you have the problem but unfortunately you are not in the campaign list” and “you can pay for repairs now, when Mercedes send you a letter you can get a refund back but how much the refund would be up to Mercedes. Oh, labor cost as well, Mercedes can do it in .5 hours so the labor that you paid for $2,000 years ago will be refunded for $150”

    Think about this, panoramic roof sliding panels were reported first time in 2017. Mercedes used the same suppliers all along and figured out the problem in 2020 before announcing a recall campaign in 2021. 2014-2020 – 15,000 invited to the campaign but “nhtsa never have a list of vin that we’re recall” only Mercedes has that 15,000. Why didn’t Mercerdes just say recall them all since all of those cars were installed defective panoramic sunroofs before Mercedes could identify the issue. The truth is Mercedes willy to paid $20 million fine but won’t show the vin that they announced once. Let me ask you this, do you have any friends, cousins, or family members that passed away from accidents? Do you know if the car is defective? Oh wait Mercedes denied those allegations because Mercedes already do their best ”voluntary recall campaign”

    2023 Mercedes just Announced 2004-2011 vehicle owners for the recalls. If they already fix they must provide “invoice from dealer, reasons must be stated, parts-Mercedes will determine how much you should get if you want to reimburse , labor-Mercedes determine how many hours is proper, and finally if you brought to fix outside so sorry you car is not covered. Lol

    I have. 2015 C300 4Matic Luxury that has the same problem of gas smell coming into the cabin when I turn the heater or a/c on.

    I purchased a 2016 c300 last year at 70,000 miles by 80,000 miles during the A service I was told the car had terminal engine failure. paid for a compression test and found out the car had already had engine issues way before I got it !! I am now stuck with a $22,000 car that I cant drive and cannot find any help.

    I have a 2017 C300 Coupe 4matic and Mercedes replaced the fuel hose in October 2019 but now again I am smelling gas. We have called the Mercedes dealership to inquire but no one has called us back. (Texas)

    I have a 2016 C 300. Whenever I turn the heater on the car smells like gas inside the cabin. I have to roll the windows down just to air out the car while stopped.

    I live in often frigid Calgary Alberta. (It’s -37 today with the wind chill) I finally saved up to buy my first used Mercedes. It’s a 2017 c300 and I was in love! This is my second winter with my car. Last winter was kind of mild… so at first I thought it was cars around me but this winter I can’t drive with the heat on without my windows open or I get dizzy. It’s either dizzy or frozen. I’m sooo disappointed. I called Mercedes and they said there isn’t a recall so there’s nothing they can do. So I had mechanic friends look into it and found out about this lawsuit. I wish I could join. I’m still paying for a car that is figuratively and literally making me sick. So upset.
