Breville air fryer class action lawsuit overview:
- Who: Zane Tran filed a class action lawsuit against Breville USA Inc.
- Why: Tran claims Breville manufactured, marketed and sold Smart Oven Air Fryer Pro oven devices containing defective glass windows that renders them unusable and unsafe.
- Where: The class action lawsuit was filed in California federal court.
Breville manufactured, marketed and sold certain Breville Smart Oven Air Fryer Pro oven devices containing defective glass windows prone to exploding simultaneously and without external impact, a new class action lawsuit alleges.
Plaintiff Zane Tran claims Breville failed to disclose the alleged defect to consumers when marketing and selling the air fryer ovens with the model number BOV900BSSUSC.
Tran argues the alleged defect “creates a serious safety issue” and renders the air fryers “unusable” after it manifests.
Breville, meanwhile, is “unwilling to acknowledge” that the Smart Oven Air Fryer Pro devices contain the defect and has refused to provide refunds to customers who have encountered it, the Breville class action alleges.
Breville accused of misleading consumers into falsely believing devices are made with quality materials
Tran claims Breville has spent decades marketing its products as “high-end luxury devices” in order to gain the trust of consumers “who reasonably believe” the products are created with quality materials.
Tran wants to represent a nationwide class and California subclass of consumers who either previously owned or currently own a Breville Smart Oven Air Fryer with the model number BOV900BSSUSC.
Breville is accused of fraudulent omission or concealment, unjust enrichment, fraud by omission, among other things, and of violating laws such as the Magnuson-Moss Warranty Act and California False Advertising Law.
Plaintiff is demanding a jury trial and requesting injunctive and declaratory relief along with an award of monetary, statutory and treble damages for herself and all class members.
Air fryers were in the news earlier this year, too.
In April, Best Buy recalled around 635,000 of its Insignia and Air Fryer Ovens over concerns they could overheat and present a fire and burn hazard.
