Dyson class action lawsuit overview:

Dyson Inc.’s warranty-voiding provisions violate federal law, according to a Dyson warranty class action lawsuit.

Plaintiff La Quita Bennett alleges Dyson informs consumers that their warranty will be void if they use third-party services to repair their Dyson products. However, this type of warranty-voiding condition is prohibited by the Magnuson-Moss Warranty Act, according to the Dyson class action lawsuit.

Under the Magnuson-Moss Warranty Act, consumers are allowed to open their electronics, appliances and other consumer goods without voiding their warranty, even if the warranty language states otherwise, the Dyson class action lawsuit explains.

The Magnuson-Moss Warranty Act prohibits warrantors like Dyson from conditioning their warranties on the use of only authorized repair service or authorized replacement parts for non-warranty service and maintenance.

Dyson class action says warranty terms intentionally misleading

Dyson misrepresents its warranty to consumers to maintain a monopoly on repairing its products, the lawsuit alleges.

“Most people won’t attempt relatively simple, inexpensive repairs–or use inexpensive third-party repair services–if they believe that in doing so the manufacturer subsequently will refuse to honor the warranty,” the Dyson class action says.

The Dyson warranty representations lead consumers to believe that a third-party repair will void the warranty, the lawsuit claims. Bennett points to provisions that state the Dyson warranty will be voided by “faults” resulting from third-party or unauthorized repairs or alterations, faulty assembly or installation by non-Dyson agents and use of non-Dyson parts and accessories.

The term “faults” is ambiguous and likely to confuse reasonable consumers, the Dyson class action claims.

Warranties like the Dyson’s also stifle competition in the third-party repair industry, ultimately inflating the price of repair, the lawsuit alleges. Customers may also face long wait times to get their product into an authorized servicer for repair.

Bennett says he purchased a new Dyson product in November 2021 that was covered by a Dyson warranty. He says he is unable to have the product repaired by a third party without voiding the warranty, which he maintains is unlawful.

Bennett seeks to represent himself and a proposed class of Arkansas residents who purchased a product covered by a Dyson warranty.

Dyson is not the only company to face allegations it misleads customers about policies that are meant to protect their products. Bob’s Discount Furniture was recently hit with a class action lawsuit alleging it often denies coverage under its “Goof Proof” protection plan even when damage is clearly covered by the policy.

    I don’t know. You can buy some parts from Dyson and they’re relatively reasonable in price. I did and I replace something myself when it broke.. oh but it was something small that I could fix myself I don’t think there’s any places near me that would be covered through Dyson so I can honestly say on this what is right… because if you take it to someone and they do a crappy job and you’re in your vacuum then it’s not Dyson’s fault. But nobody wants to company where you can’t buy the parts you need just anywhere so…. It just depends.

    I have replaced 4 different vacuumes because their warrantee and replacement part costs make it cost prohibitive. I do like the product, but even the batteries are expensive to replace almost every 2 years.
