Sprint premium sms settlement

A settlement has been reached in the Sprint premium SMS lawsuit, resolving claims that Sprint Corp. consumers were charged by the phone provider for unauthorized third-party services on their monthly cellphone bill by premium SMS companies. Premium SMS companies provide services like ringtones, wallpapers, and horoscope and celebrity gossip text messages. This Sprint Premium SMS settlement is not related to direct carrier billings or Google Play charges through a Sprint wireless phone.

This premium SMS lawsuit was first brought against Sprint in December 2014 by the Consumer Financial Protection Bureau, a federal government agency. This lawsuit alleges that Sprint violated the Consumer Financial Protection Act when the wireless phone provider allegedly charged its consumers for unauthorized third-party charges. This Sprint premium SMS settlement will provide monetary and injunctive relief for Sprint consumers.

Sprint denies all liability in this premium SMS lawsuit, but has decided to settle in order to avoid future court and attorney costs, as well as the uncertainty of continued litigation.

UPDATE: On May 17, 2016, the settlement website has been updated with the following statement: “Starting in approximately late May 2016, checks will be distributed to verified claimants.  Checks will continue to be distributed throughout June.”  Top Class Actions will continue to provide updates as we learn more.  Keep checking back and let us know when you receive a check in the comments section below or on our  Facebook page.

Who’s Eligible

According to the Sprint Premium SMS lawsuit, eligible Class Members will include:

“Current and former Sprint postpaid and prepaid customer account holders (Sprint customers) who paid for unauthorized third-party PSMS charges after July 1, 2010 and who did not receive a credit for those charges may apply for refunds.”

Potential Award

Varies.

Sprint postpaid consumers are eligible for full refunds for the unauthorized third-party charges if they were not previously refunded by the wireless carrier.

Sprint prepaid consumers, including those who use Virgin Mobile, Boost Mobile, Sprint Prepaid, and Assurance Wireless, are eligible for a one-time $7.00 refund for unauthorized charges that were not previously refunded by their wireless carrier.

Proof of Purchase

In order to receive a monetary refund in this Sprint premium SMS settlement, you must submit a completed claim form online or print and fill one out and mail it to the Claims Administrator by Dec. 31, 2015.

        I just got my check today actually. It was for 167.59 and dated Nov 17, 2016. I had forgotten about it until I checked the mail today. I thought the max was 138.00 but I guess not. I am pleasantly surprised and it came at a very dire time financially and is going to help considerably.

    Jennell how did you get a hold of admin. I have been calling for 2 wks now and they do not offer a prompt to speak with a representative. There are no attorneys as this is sprint government restitution. I sure would be nice to see this show up this week but I have my doubts. It is the 5th of May and no one is saying there check has arrived in the mail if these were mailed on Monday by what you say from a rep.

    I just got my reimbursement from Sprint credited to my account (current customer). Got a text message of: On 05/03/2016, a $389.61 account credit was applied. I checked and it is true. It notes it is for Premium SMS refund. I am very surprised and pleased. I have been a Sprint customer for 10+ years.

    I hope you are right Jennell. I tried call admin on friday and there was no longer an option to dial 0 # for a person. Have been waiting for this one forever! I have a very significant claim and have checked on it throughout this process. I was very discouraged not to have the option to talk with someone at 1pm on a friday afternoon.

    I bought a new phone and my bill doubled on the next one I received. I paid for my phone, they charged my account twice for the amount of the phone. It took a week to get the extra charge corrected. then when my bill came my plan had been changed and my previous plan was no longer available. The new plan I never ASKED FOR WAS DOUBLE . I spent 2 hrs on the phone and my husband spent 3hrs 45min on the phone and we couldn’t resolve anything. He spoke to 5 different sprint reps and they gave us a run around. How can they get away with this stuff legally????? All I wanted was a new phone (old one not working) and I got my phone bill doubled as a result , still smh!

    I have recently was being charged 9.99 for a service I had no idea what it was not did I order for 1 1/2 yrs before I noticed and they refused to refund any money and I was a vip 10 yr customer I sure would like to get the 160$ back on top of whtever they over me for the yrs they charged me on both lines for 7yrs+ that I didn’t authorize because I’m 100% possitive it’s hundreds and hundreds of dollars they owe me for both lines I had!!
