Sprint premium sms settlement

A settlement has been reached in the Sprint premium SMS lawsuit, resolving claims that Sprint Corp. consumers were charged by the phone provider for unauthorized third-party services on their monthly cellphone bill by premium SMS companies. Premium SMS companies provide services like ringtones, wallpapers, and horoscope and celebrity gossip text messages. This Sprint Premium SMS settlement is not related to direct carrier billings or Google Play charges through a Sprint wireless phone.

This premium SMS lawsuit was first brought against Sprint in December 2014 by the Consumer Financial Protection Bureau, a federal government agency. This lawsuit alleges that Sprint violated the Consumer Financial Protection Act when the wireless phone provider allegedly charged its consumers for unauthorized third-party charges. This Sprint premium SMS settlement will provide monetary and injunctive relief for Sprint consumers.

Sprint denies all liability in this premium SMS lawsuit, but has decided to settle in order to avoid future court and attorney costs, as well as the uncertainty of continued litigation.

UPDATE: On May 17, 2016, the settlement website has been updated with the following statement: “Starting in approximately late May 2016, checks will be distributed to verified claimants.  Checks will continue to be distributed throughout June.”  Top Class Actions will continue to provide updates as we learn more.  Keep checking back and let us know when you receive a check in the comments section below or on our  Facebook page.

Who’s Eligible

According to the Sprint Premium SMS lawsuit, eligible Class Members will include:

“Current and former Sprint postpaid and prepaid customer account holders (Sprint customers) who paid for unauthorized third-party PSMS charges after July 1, 2010 and who did not receive a credit for those charges may apply for refunds.”

Potential Award

Varies.

Sprint postpaid consumers are eligible for full refunds for the unauthorized third-party charges if they were not previously refunded by the wireless carrier.

Sprint prepaid consumers, including those who use Virgin Mobile, Boost Mobile, Sprint Prepaid, and Assurance Wireless, are eligible for a one-time $7.00 refund for unauthorized charges that were not previously refunded by their wireless carrier.

Proof of Purchase

In order to receive a monetary refund in this Sprint premium SMS settlement, you must submit a completed claim form online or print and fill one out and mail it to the Claims Administrator by Dec. 31, 2015.

    I called when the text hit my phone that Sprint credited me $44.54. I have a 1080.00. 2 phone line claim with this class action. I was told they HAVE NOT paid anything out on this settlement. I have not contacted Sprint as the class action regs say not to. Sprint is crediting current customers and it is not these SMS charges. I think they are being held to the new laws from this class action and are correcting error with existing customers.

    I just received a $335.66 credit for a Premium SMS Refund. My account shows a negative balance. Thank you. I shouldn’t have a bill till June. Lucky day is right.

    Just got a text message from Sprint saying they credited my Sprint account $119. Just checked my account and sure enough there’s a -$119 posted. Its a good day.

    Me too!!! My contract keeps changing, I renewed, ironically found notes today, no idea what final call will resolve in, BUT SO SICK OF IT!!! Basically everyone you speak to, if they verbally make promises, don’t document, your screwed!!! I kept a plan in order to keep \ a plan no longer offered, 2/ phones etc, one I put on seasonal, told if not I’d loose that plan its not offered any more. I have JUST found all documentation . WIll reach out one more time, then, CIVIL-BBB LEGAL. I’m currently in wheelchair, can’t get out walk etc, temporary. But each person that lacks proper training, makes it snowball. Handicapped, crippled, isolated, CANT go store!! My circumstances temporary. 14 yrs, and x3 of very few reps seei ng issues. I’m in too much pain to play on phone circle jerk!!! Documentation is key. Dates&times and names in 3yrs can be verifiable. I hope ANYONE similar, keep track, the reps via phone are good or not!! In the end its consumer abuse, when resolution department promises calls from investigation resolution or whomever. I’ve had enough!!! Calls need to be recorded but not necessarily. I’m sick OV being taken for granted, and cust

    I have been trying for days to file a Sprint claim online. Unfortunately, the site will not accept any of my email accounts: not yahoo, gmail nor ymail. Please let me know what I need to do to file online before the deadline. Thank you. AnneMarie

    Aside from all the above fails Sprint has done, what about having your credit dragged thru the mud for their false claims that I received a phone in the mail that I never ordered, let alone received? It’s been 5 years and those charges which are now almost $500 for a basic, no so smart phone still show as a black mark against me. Absolutely loathe Sprint.

    I too, have had problems with Sprint over charging me. I would call every month for an adjustment, they adjusted my bill once. My bill was never accurate. Sprint would always have some charge on my bill that they could not explain to me. I got so sick and tired of paying over 160.00 a month. I never was charged the correct amount, yet I tried to stay and remain a loyal customer. I now see where Sprint loyalty is, and its not with their customers. I switched to another plan, and I love it! I am more than sure Sprint owes a lot of consumers big time!

    Ive been charged almost 2400 dollars by sprint for a phone they claimed was being sent free of cost now there saying i owe all konds of money.
