UPDATE:

  • On Jan. 14, 2020, Class Members in a lawsuit against Sirius XM Radio asked a federal judge for final approval of a class action settlement worth $32.4 million arising from claims that the satellite radio service violated the Telephone Consumer Protection Act.

Sirius XM has agreed to pay $25 million and provide free services as a part of a recent TCPA class action settlement.

The settlement will benefit all individuals who received call from Sirius XM despite having been put on the National Do Not Call Registry over 31 days prior or on SiriusXM’s internal Do Not Call List.

Individuals need to have received more than one telemarketing call from Sirius XM in a 12 month period between Oct. 16, 2013 and April 26, 2019.

Plaintiff Thomas Buchanan filed his class action lawsuit against Sirius XM in March 2017. According to Buchanan, Sirius XM called consumers for telemarketing purposed despite some consumers being on the National Do Not Call Registry and the company’s own internal do not call list.

Buchanan argued that these calls violated the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law that helps to protect consumers from harassing telemarketing practices. The act includes protections from calls in  which consumers have placed themselves on the National Do Not Call Registry or a company’s do not call list.

Sirius XM has not admitted any wrongdoing but has agreed to settle the class action lawsuit. The settlement notes that “the proposed Settlement does not mean that any law was broken or that Sirius XM did anything wrong.” Instead, a settlement allows the claims to be resolved without the stress, costs, and risks of a trial.

Under the settlement, Class Members can receive three months of access to Sirius XM’s All Access Subscription package or a cash payment. The cash payments are estimated to be around $12.

In order to receive a cash payment, Class Members need to file a valid claim by Oct. 8, 2019. In order to receive free service, Class Members need to file a valid claim by Dec. 22, 2019.

The deadline for exclusion and objection is Oct. 8, 2019. The final approval hearing for the settlement is scheduled for Nov. 7, 2019.

Add me if able to. I use the Hiya app and finally they just get hungup on. I get one ring and it’s trashed. But it’s still a pain to keep getting them. And they sure have a ton of different area codes that they use!

  6. Angry Here says:

I purchased a new vehicle in late 2018 long after the filing date of the lawsuit. The dealership and Sirius made an agreement concerning a free 90-day access to which I have never been a signatory. Sirius XM sent renewal requests which I never answered, and no telephone calls were made to me. Technically, I have no direct business relationship with them and never have. (No matter what they provided to the dealer, my ability to purchase a vehicle cannot be contingent upon any implied obligations forced on me by a third party….that would amount to an illegal combination in restraint of trade and therein such action would be tantamount to conspiracy to commit a fraud, and this relegates any such contract to be illegal and therefore null and void.) That said, I have recieved a notice of this suit which means someone has released a list of names to someone else regarding private parties (car buyers) who were not involved at the date of filing! I don’t give a damn if it was a judge who so ordered it….these people have violated my privacy!!! To make it worse, in researching this I find that the radio technology regarding Sirius does in fact have capabilities that can be used as a tracking device without my consent. Now I have to worry where this list will go and who will access it. Needless to say, I’m freakin’ pissed. Where’s the oversight by the Supreme Court and the Congress???!!

Presently paying $22.97 per month for Sirius coverage. Total amount is $275.64 for a year. I have no idea if this is overpriced. I live in the state of Pennsylvania. Thanks for any information.
