Consumers who submit a claim form could benefit from a $102 million judgment against On Point Global LLC in a Federal Trade Commission (FTC) lawsuit over the company’s fraudulent website schemes.
Consumers are eligible for this judgment if they purchased a guide from On Point Global in 2017, 2018 or 2019 and were not satisfied with their purchase or if they provided their personal information to On Point Global in 2019 and were not satisfied with their experience.
On Point Global publishes online editorial and digital guides on a number of subjects, including automotives, finance, legal services, homes, community issues, marketplaces, recreation and travel. The company then “captures” consumer data and uses that information to identify customer behaviors.
However, On Point Global allegedly misled customers into handing over their personal data.
The FTC filed a lawsuit against On Point Global in December 2019, claiming the company promised customers a quick and easy way to complete government services such as renewing driver’s licenses or checking eligibility for government programs. The branding and language of these websites allegedly mimicked government sites which convinced consumers to hand over sensitive information such as credit card data, personal identifying information, and more.
After handing over this sensitive data, consumers started to receive harassing marketing emails and text messages from third parties, the FTC maintains. According to the federal regulator, these messages started when On Point Global made millions by selling sensitive consumer data to third parties.
The FTC requested a preliminary injunction against the company to shut down its allegedly fraudulent websites. The court agreed in February 2020, finding the FTC would likely prevail in trial by successfully proving that “the websites were patently misleading.” This came to pass in November 2021 when the court ruled against On Point Global and ordered the company to pay $102 million to affected consumers.
Under the terms of the judgment, affected consumers can receive a cash payment.
Payment amounts will vary depending on the number of claims filed and how much personal information each consumer provided to On Point Global. Consumers who provided more information could receive larger payments than those who only shared a small amount of information.
Consumers who already received a refund from the company may receive smaller payments from this judgment. According to the judgment website, payments will not be more than $15.
In order to receive benefits from the On Point Global FTC lawsuit judgment, class members must submit a valid claim form.
The deadline to submit an On Point claim form is Aug. 31, 2022.
