Enfamil false advertising settlement checks

Top Class Actions readers are receiving checks from an $8.4 million false advertising class action settlement over Enfamil formula.

The settlement benefits consumers who purchased various Enfamil products, listed on the settlement website, between Jan. 1, 2017, and June 23, 2022.

According to the false advertising class action lawsuit, Enfamil formula products advertise an inflated number of servings possible from each package. Consumers say they overpaid for Enfamil formula based on these misleading representations.

Mead Johnson & Co. agreed to pay $8.4 million to resolve the false advertising class action lawsuit. Under the terms of the settlement, consumers could receive up to $3 per Enfamil product for payments of up to $15 without proof of purchase or $45 with proof of purchase. Our readers report payments of $15 from the settlement.

The deadline to submit a claim with the settlement was Oct. 31, 2022.

The Enfamil false advertising class action lawsuit is Wacker, et al. v. Mead Johnson & Co. LLC, Case No. 22PH-CV00808, in the Circuit Court of Phelps County, Missouri.

PBM Nutritionals false advertising class action rebates

Settlement checks are in the mail from a $2 million false advertising deal resolving allegations that various baby formula products are marketed with misleading claims.

The settlement benefits individuals who purchased Well Beginnings, Meijer Baby, Little Journey, Wesley Farms, Burt’s Bees Baby, Berkley Jensen, Parent’s Choice, Earth’s Best Organic, Comforts, Up & Up, Babies “R” Us, Member’s Mark or Bobbie Baby brand formula products between Jan. 1, 2017, and July 21, 2022

Plaintiffs in the false advertising class action lawsuit accused PBM Nutritionals of overstating the number of servings each container of baby formula could make. The company allegedly overstated the number of possible servings by 7.9% to 12.1%.

PBM agreed to pay $2 million to resolve the false advertising class action settlement. Under the terms of the settlement, consumers could receive $2 per purchased product for a maximum payment of $10 without proof of purchase or $30 with proof of purchase. Top Class Actions readers report receiving payments of $10.

The deadline to submit a claim with the settlement was Nov. 30, 2022.

The PBM Nutritionals formula class action lawsuit is White v. PBM Nutritionals LLC, Case No. 22PH-CV00931, in the Circuit Court of Phelps County, Missouri.

AmeriGas propane tanks settlement checks — second distribution

Top Class Actions readers report a second round of payments from a $6.5 million AmeriGas propane tank class action settlement.

The settlement benefits consumers who bought or exchanged one or more AmeriGas and/or Blue Rhino pre-filled propane tanks between Dec. 1, 2009, and Nov. 30, 2020.

The propane tank class action lawsuit claims that AmeriGas and Blue Rhino conspired together to lower the capacity of their pre-filled propane tanks. The scheme allegedly reduced the capacity of tanks from 17 pounds to 15 pounds but failed to lower the price to compensate for this lower volume.

AmeriGas and Blue Rhino agreed to pay $6.5 million to resolve these allegations. Under the terms of the settlement, consumers could receive up to $125 without proof of purchase or higher payments with proof of purchase. Consumers who received an initial payment recently received a second distribution of $3.47 each.

The deadline to submit a claim with the settlement was March 8, 2021.

The Propane tank class action lawsuit is In re: Pre-filled Propane Tank Antitrust Litigation, Case No. 14-md-02567, in the U.S. District Court for the Western District of Missouri, Western Division.

On Point Global websites FTC refunds

Checks are in the mail from a $102 million settlement between On Point Global and the Federal Trade Commission (FTC).

The settlement benefits consumers who purchased a guide from On Point Global in 2017, 2018 or 2019 and were not satisfied with their purchase. The settlement also benefits consumers who provided their personal information to On Point Global in 2019 and were not satisfied with their experience.

According to the FTC, On Point Global operated several fraudulent websites which deceived consumers into paying for guides on government services and benefits. These websites allegedly resembled legitimate government websites in an attempt to mislead consumers.

The FTC reached a $102 million settlement with On Point Global, from which consumers could receive a cash payment. Top Class Actions readers report receiving payments of $15 from the FTC settlement.

The extended deadline to submit a claim with the settlement was Oct. 18, 2022.

The On Point Global FTC lawsuit is Federal Trade Commission v. On Point Global LLC, et al., Case No. 19-CV-25046-SCOLA, in the U.S. District Court for the Southern District of Florida.

Facebook BIPA settlement checks — second distribution

Top Class Actions readers have received a second round of settlement checks from a $650 million class action settlement with Facebook over alleged violations of Illinois’ Biometric Information Privacy Act (BIPA).

The settlement benefits Facebook users in Illinois for whom Facebook created and stored a “face template” since June 7, 2011.

Plaintiffs in the class action lawsuit accused Facebook of collecting “face templates” of their facial geometry scans in violation of BIPA. Facebook allegedly failed to get consumer consent as required by BIPA.

Facebook agreed to pay $650 million to resolve the BIPA class action lawsuit. Under the terms of the settlement, consumers could receive an equal share of the net settlement fund which ended up being $397 per claimant. According to our readers, a second distribution resulted in payments of $30.61 each.

The deadline to submit a claim with the settlement was Nov. 23, 2020.

The Facebook BIPA class action lawsuit is In re: Facebook Biometric Information Privacy Litigation, Case No. 3:15-cv-03747-JD, in the U.S. District Court for the Northern District of California.

Massachusetts drug conviction class action rebates

Checks are in the mail from a class action lawsuit with Massachusetts authorities over claims the state failed to refund court costs after convictions were overturned.

The settlement benefits individuals who were convicted of state drug offenses in Massachusetts and whose convictions have been vacated and dismissed without the prospect of re-prosecution due to drug lab misconduct.

Misconduct by chemists at the William A. Hinton State Laboratory Institute resulted in over 16,000 drug-related offenses being dismissed due to concerns that evidence was tampered with. Despite vacating these convictions, Massachusetts allegedly failed to refund individuals for court-related fees.

Massachusetts agreed to a class action settlement to resolve these claims. The settlement allowed individuals to seek a refund of up to $150. According to Top Class Actions readers, actual payments were twice that sum, at $300.

The deadline to submit a claim with the settlement was April 6, 2023.

The Massachusetts conviction class action lawsuit is Stacy Foster, et al. v. Commonwealth of Massachusetts, Case No. 1984CV03373-C, in the Massachusetts Superior Court for Suffolk County. 

Par-A-Dice BIPA settlement checks

Top Class Actions readers report receiving settlement checks from an $825,000 class action settlement with Par-A-Dice Hotel Casino over BIPA violations.

The settlement benefits consumers whose faces were recorded by security cameras at Par-A-Dice’s sportsbook in East Peoria, Illinois, between September 2020 and June 2021.

Plaintiffs in the BIPA class action lawsuit claim that Par-A-Dice uses facial recognition in its security systems. The system allegedly collects facial geometry scans of casino visitors without getting consent as required by Illinois law.

Par-A-Dice agreed to pay $825,000 to resolve these claims. Under the terms of the settlement, consumers could receive an equal share of the net settlement fund. Our readers report receiving settlement checks worth $132.

The deadline to submit a claim with the settlement was Feb. 6, 2023.

The Par-A-Dice BIPA class action lawsuit is Pruitt, et al. v. Par-A-Dice Hotel Casino, et al., Case No. 2020-L-000003, in the Circuit Court for the 10th Judicial Circuit of Tazewell County, Illinois.

Bansley & Kiener data breach class action rebates

Settlement checks are in the mail from a $900,000 class action settlement with Bansley & Kiener resolving claims the company mismanaged a data breach in 2020.

The settlement benefits a nationwide class of consumers who received a notification from Bansley & Kiener informing them their information may have been compromised in the 2020 data breach.

According to the data breach class action lawsuit, Bansley & Kiener knew about the 2020 data breach for a full year before disclosing the event to affected individuals. This delay allegedly denied consumers the opportunity to take prompt action against the breach.

Bansley & Kiener agreed to pay $900,000 to resolve the data breach class action lawsuit. Under the terms of the settlement, consumers could receive payments of up to $5,000 depending on the damages they experienced as a result of the breach. One Top Class Actions viewer reports receiving over $61 from the settlement.

The deadline to submit a claim with the settlement was Dec. 12, 2022.

The Bansley & Kiener data breach class action lawsuit is Nelson v. Bansley & Kiener LLP, Case No. 2021CH06274, in the Circuit Court 1st Judicial Circuit Cook County, Illinois.

Chipotle delivery fees settlement checks

Top Class Actions readers have received settlement payments from a $4 million Chipotle class action settlement over hidden delivery fees.

The settlement benefits consumers who placed a delivery order with Chipotle through the restaurant’s website or app between May 11, 2020, and Jan. 19, 2022.

Plaintiffs in the class action lawsuit accused Chipotle of charging hidden service fees and upcharging for menu items on delivery orders. These practices allegedly contradicted the restaurant’s promises of “free delivery” or “$1 delivery.”

Chipotle agreed to pay $4 million to resolve these claims. Under the terms of the settlement, consumers could receive cash payments or vouchers.

The deadline to submit a claim with the settlement was June 28, 2022.

The Chipotle delivery fees class action lawsuit is Aaron Aseltine, et al. v. Chipotle Mexican Grill Inc., Case No. RG21088118, in the Superior Court of the State of California for the County of Alameda.
