Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.
The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.
BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.
Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.
Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.
Who’s Eligible
Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.
The following vehicles are covered by this settlement:
- 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
- 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
- 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
- 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
- 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
- 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
- X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
- X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
- X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award
Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.
Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:
- Three free future oil services, up to $75 per service.
- Free engine replacement.
- Reimbursement of past oil services, up to $75.
- Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
- Reimbursement for the cost of a replacement battery that was less than 3 years old.
- Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase
If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

I purchased my 2011 550xi in January and took it to a bmw dealership in both September and in March nobody at either dealership thought to mention the lawsuit and fix to the problem. Took my car yesterday to a North Carolina bmw dealership and was told about the class action suit. Told me if approved they’d put a new engine in or replace the valve stems. Bmw said I needed a new engine but they will only cover 55% of the costs which leaves me with a $7,100 repair cost because I have 80k on the car. When I originally took it to the first dealership I had 50k on it and according to the law suit they would pay 97-100% of the costs for the new engine. Completely unacceptable
Hi,I just had my engine replaced on my 2012 x5 twin turbo and now my turbos are going bad still have the bad exhaust smell in my car can this all be related,I’m so tired pf having to travel an hour and half to the dealership. I have had my car for a little over 2 years and I have spent so much time and money this car it is so upsetting.

I am fuming with BMW! I have a 2011 X5 50i and it is consuming a lot of oil. I took t to them on numerous occasion without fixing the issue. I expressed that I knew the warranty would expire in June and needed it addressed. They dragged out the process until the warranty lapsed and now wants me to pay $10000 for an issue that they are liable to fix
Hi Karen, How does your story end? I’m in the same boat. 2011 X5 currently with 135K miles. When I told the BMW dealership I don’t have $20K for the new engine and other miscellaneous issues, they told me to call a salvage company!
hi just took my car in for the oil problem..it is a 09 750li and told me i drive too much and it has too many miles for them to do anything if the cars were not meant to be driven daily they should let there clients know.. dose anyone know the top mileage before they don,t cover anything…
You should also check out the timing chain issue.. THEY call it a customer care package to avoid a lawsuit for a recall.. i drive a lot so i pay cash for oil changes a different places and they wanted me to provide them with every oil receipt which i only save for a couple of weeks in the car and toss them at the car wash no issue in two weeks they did a good job toss it.. So if they know the Gide rails go bad and it affects the timing which affects the whole engine they should recall this madness…
Is there a set time limit in which BMW has to make repairs after your first oil consumption test? My car failed the first one and was approved for valve seal replacement, two months later I’m still waiting for them to schedule my repairs.

I had a 14 7 series. I was advised to always carry oil (which I did) because the performance engine will burn excessive oil.

David just wondering if you’ve had any luck? I bought a 550i 2 years ago and only got to drive it maybe 6 months before the oil light started coming on and the engine blew. I’ve ordered a new engine. Have you gotten any luck on this? just bought a 2012 BMW 550I which has always been serviced at BMW dealerships and the extended warranty is about to run out and they are telling me over 10k in repairs due to the engine. Does this class action lawsuit cover this? is it too late to file? is there any other lawsuit against BMW ?

I have a 2012 BMW 750i that’s in the shop right now for excessive oil consumption and misfiring. I have been spending money on this engine. BMW is doing something wrong or keeping secrets about this engine. I’m tired of spending money on this engine. They have had a lot of recalls and they have said that the engine is no good. I’m tired of BMW not owning up to their mess up. What can I do. Also, they say that i need ignition coils and spark plugs. I just replaced all of those. Help someone please.

take your car ASAP to BMW dealer, they will run a test (pass/fail) and should pay for all the work should it fail the test. Warning , they will charge you for the visit if it passes, then find other things wrong as usual for car repair places.
I brought my car in for oil change UNDER my service agreement LESS than a month later warranty expired I lost one remote
Anoher BMW dealer in Westchester said my seat belt had an “electrical problem” $800 to make it right
They said they found all 4 run flat tires were damaged (one was less than a yr old) asnbd I needed 2 rims for the 750 IL X drive 2014
