Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    My 550i is currently at the dealership as the “low oil” light continues coming on, despite excellent maintenance and oil changes, last one a month ago. The dealership is now saying it may be a deeper issue and that there is no leak, but yet it has 5.3l of oil instead of the 9l it is supppose to have. They want me to pay out of pocket to see if it may be an “internal engine problem” or a “piston ring” and when I asked if they had contacted my warranty company they said “typically they don’t cover these issues” and when I told them to contact them, I was informed by my warranty company that there is currently a law suit regarding “oil consumption problems in my exact model and year of BMW”. The dealership is wanting to move forward with analyzing the problem, and I am awaiting an answer from my warranty company as to if they will cover the expenses of the analysis. Any suggestions would be greatly appreciated.

    As a serial owner of the 7 series BMW, I am very disappointed in the way BMW is choosing to handle their excessive oil usage problem. This will be my last BMW. It seems that BMW dealers are playing pre-settlement games. In trying to consider my options, including replacement of the engine, I visited a local BMW dealer and the refused to give me a quote as to the cost of replacing my engine saying that “Each engine and car is different so they could not give me a quote even though my car was right there to look at. They seemed very uninterested. I’m sure the price to replace the engine will change when the settlement goes through and that option becomes available.

    I have a 2006 750li that burns oil like there’s no tomorrow. I have to put in at least one quart every couple of weeks. Now I’m noticing oil leaks and lots of smoke after idling. Im so embarrassed. Everything on this car all of a sudden seems to be falling apart, as well. Plastic cheap junk anymore. I have even managed to have both sun visors fall off as I turned them down to use. And NO….Im not hard on things…. the knobs on the seat adjustments are crumbling, the drink holder in the back seat fell apart, the back door handle sticks when you open it from the outside, and even the back window shade has disintegrated at the rollers. This car is a huge POS, but handles very well and gets on it, when I need to hop on the freeway (think those old CA HWY 99 180 degree on-ramp “hooks” that haven’t been re-designed yet to soften that angle)

    1 have 2011 x5 with a n63 engine .i use about a quart of oil every 1000 miles . my car is part of the lawsuit.
    the bmw dealer here in san antonio charges $149.00 for a oil change but the settlement says we will receive 3-$75.00 credits for 3 future oil changes. so we still have to pay $75.00 for a oil change done at the bmw dealership. not a very good deal

    Do these cars require expensive synthetic oil or is normal oil ok? Buying bulk normal oil at an auto parts store is not expensive for someone with a $50k car, and oils easy to add. You don’t need an oil change. Every driver needs to know how to check and add motor oil. And tire air and coolant etc.

    I had an 89′ 525i and have a 98 528i. Both blew their head gaskets. Apparently, as much of a pleasure the cars are to drive, they can’t figure out how to manufacture an engine that works.

    2009X5 had oil change need oil after a trip from New York to Florida. Was told that is normal.

    I’ve had the same problem with my 330I and now from my Z4 roadster and the years or different but same problem. I took it to my mechanic for oil leak issues on 06/30/18 and he told me the BMW’s have an oil problem with their vehicles. Who knows how much that will cost , me

    i have had these same problems with my 2013 bmw but i don’t see it on here is it not included in the lawsuit an can i do a separate suit

    I have the same issue with my 2007 528XI.
    I am sure I’m not the only one with this issue, my car has 67,000 miles and properly maintained.
