Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    I have a 2012 650I Coupe purchased from BMW Dallas. I have had it 3 years and it has been in service every 2-3 months for the same issues (Coolant and oil consumption issues). It is back there today and BMW called and informed me of the recall on the motor due to oil consumption and the lawsuit. Well after researching, as most of you have said the window has passed to get in on this suit. I too have been told that they will run motor test on the car and I may or may not need another motor and I may be responsible for half the cost of a new motor, which is BS!!!! If anyone knows who I can talk too I would appreciate the info.

    This is not a viable solution to a very serious and costly problem. I have an X5 that is part of this class action. I have been in contact and spoken to a BMW dealership since I purchased this car approximately 16 months ago regarding the oil consumption problem and was told <1,000 miles was normal? Shortly thereafter I received the class action postcard. I cannot drive more than 500-750 miles without dropping 1L Oil into this vehicle. I've been through the class action steps!. Had a loaner for 2 months, failed oil consumption test #1, Failed oil consumption test #2, and now they have told me that "the vehicle definitely needs a new motor". They followed that statement with "BMW only covers 10% of the engine replacement costs which totals $7,000" or your vehicle has a trade in value of $7,000 if you wanted to trade it in for another vehicle. I have owned this vehicle for 16 months. I paid $16,000 for a vehicle that has burned oil from day 1, traveled back and forth to the dealership to "swap" cars for these tests numerous times and now it's worth <50% of what I paid for it? BMW should be ashamed of themselves. This is not a solution for a poorly manufactured product. As far as I can see here's our options: Continue dropping oil into your car (as if the class action suit didn't even exist, what a waste of time and $$) or pay the $5-$7000 for a new motor that they will not warrantee as it goes by the miles on your original motor. If you try to trade your car into a NON-BMW dealer they will give you NOTHING for it, as they will then have to repair/warrantee it, or have an upset customer on their end. THERE IS NO WIN HERE!

    This is horrible situation. Our engine froze and now BMW refuses to cover it and the class action website gives us no option. Dealership wants 9 K for a new engine and car is barely worth 10 K!
    This is our second bad BMW experience. We will probably end up selling this 550I as salvage. I have poof that car was consuming oil but because it had enough oil when the engine died, BMW takes np responsibility and this is not covered under the settlement. Whoever settled this case sold rest of us down the river!

    I just purchased this vehicle less 3 months ago. Took it to the dealer due to having to put oil in already three times and coolant twice. Took it to the dealer since we are a couple of weeks from the warranty expiring and I was told about this class action suit that I’ll already too late on. Who can I talk to. They are giving me a new battery and going to run test but said I could still be responsible for paying portion of the engine. Anywhere from 5 to 100 percent. Just depends. Still waiting to hear back from BMW of their findings. Upset that I didn’t know. Dealer that sold me the car never said anything about this. It’s a 2014 BMW 750LI. Any advise on who I can speak to or am I’m really out of luck since the deadline has passed?

    i have a 2013 bmw 550i and the moter froze moday 11/12/18. with 45000 miles . what if anythinge can i do to get bmw to repair the moter?

    I just heard about the suit. Please direct me how to submit a claim for my 2009 750 Li (that had to be returned for repeated failure) and my 2011 750 Li. that was towed seven (7) times. Major oil leaks.

    I Have filed a claim but no one has responded to the claim how can you call and speak to a live person because all you get are recording’s and steps to tell you what the lawsuit is about I would like to speak to a person for clarity. So how do you go about that is sort of confusion to me and probably many others that has either filed a claim or not certain if they file the claim the right way and was filled out properly.Certainly the deadline is over or Filing the claim but in my case I haven’t spoken to no one has contacted me to tell me if my claim is submitted properly and someone is doing something about the issues that I have with the vehicle HELP.

      You do not need to file anything. Just take your car to the dealership and they will take care of it. But make sure it is under 120k. They will offer you replacement engine which is cost you at least $5000. Also you may have other problems too like Fuel Injectors are broken and it would be free to repair!

        What dealer did you go too? My local dealer is acting like they have no knowledge of this suite. My engine is blown at this same dealer currently.

    I just stumbled on this class action lawsuit today and I own a 2012 X5 50i that has been in the shop more than I have driven it , currently it is in the bmw service center with a blown motor , 30 plus days now with no new motor in site ,,not to mention my extended warranty company is not covering the full cost to replace the motor, last winter it was in the bmw service center with bad rear seals “burning oil like crazy . If anyone can please help me , bmw has put me in a rental car not even close to my X5 .

    Same here. Never received a postcard in the mail advising us of the Class Action Lawsuit. Our 5 series has had multiple oil problems since it was parked in our driveway on day 1. It’s been in for servicing 4 times now in 24 months, ran low on oil even though it had just been serviced. How do we submit, if the date has passed? And why was the filing window date so short? By the time anyone finds out about this, the filing dates are long but past.

      BMW is real shitty company and got cars. Ifyou can get rid of your car, buy.a Porsche! Porsche never break down and customer service is fantastic. You can take yourcar to dealership and they will follow up with class action. They will tell you you need new engine which is cost you at least $5000 because BMW is not covering everything

    I own a 528i BMW and just found out about the Class Action Lawsuit. I would like to submit a claim to be apart of this lawsuit. I did not receive a card in the mail regarding this Class Action Lawsuit. What would be my next step to submit a claim for future reimbursements?
