Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    My car is in the shop now because of the excessive oil consumption. I do have a warranty on the car, thank goodness for that, but it takes about 3 weeks to fix the problem. Then the car on top of it started leaking oil. BMW dealer told me that they have to take the engine out of the car to work on it. I never received a letter about a class action suit. What recourse do I take now?

    I have the same problem. I wasn’t notified of the suit until after the deadline expired. Additionally, my engine has now started drinking oil at or more of the rates discussed here. What recourse do we have by a poor notification system, bmw declining any mechanical problems and paying excessive cost to maintain the vehicles? Respectfully engines don’t burn oil unless it is leaking (that isn’t a burn) or there is blow-by in the combustion chamber.

    I recently found out about the class action issue, and called the Bmw dealership that I purchased not only my 2013 X6, but 750 LI and other bmws. The service advisor told me that my X6 had the specific engine that was having issues, and there was nothing Bmw could do. Is there any way I could get support from the lawsuit this late?

    I have the same issue with my 2012 750 li. Consuming oil, always adding a quart. I was not informed about this class action and as I read the deadline is expired. Do I have any options to rectify the engine issue?

    I had an independent Master BMW look at my 2011 X5 Turbo. I have all the same issues plus replaced the rear suspension air bladders, pretty much the whole coolant system (even the tank cracked and leaked out the $45/gallon coolant in a client parking lot), upper oil pan leak that BMW asked $3,000 to fix a $25 leaking part. Plus I have the valve deal guide that BMW also asked $7,000 to fix.

    I took my SUV to an outside BMW Master Mechanic and his feedback was that BMW used a very poor metal on the value guide and other automakers use brass. I have a Toyota with 145K miles not one leak. This is really not just about oil burning but more about BMW taking short cuts with poor materials that are cheap to buy but expensive to replace.

    I have, yet another recall to get fixed next week, and I have sent this to the dealer to discuss the options they may provide. My good fried is a mechanic there as well and he told me a few years a go to get rid of this SUV. Sounds like going back to Lexus or someone else is a better plan and just potentially drive this thing into the ground.

    The class action should be around their knowledge around the “real” issues with system failures due to poor MFG process and not real quality control. I find it hard to believe that they did not know these exist when their own mechanics know they do.

    I got screwed by BMW, They knew all about the problems . They strung me along until i was out of warranty . I ended up with a X 6 with a bad motor and got screwed on the trade . They knew it all along . They should be sued. So they will pay me for my oil.
    What a joke!

    My BMW 2009 750i still consum a large amount of oil. What can be done about that?

    I’ve had BMW replace my engine’s head gaskets due to excessive oil consumption (at their recommendation) and pay over $2000 for that repair and it did nothing. I do not receive any notification about this class action lawsuit and now it’s after the deadline date. What options do I have?

      I have the same situation with a 2010 750i. Oil leakage, needing to add oil, battery required replacement, etc

    I have a 3 series that has been having the same problems. Why weren’t the 3 series included in this suit?
    My car already has racked up 4 or more recalls. My oil has been leaking, my battery is fairly new but is always dead or weak. Turn signal has a short in it. complete headlight had to be changed out because it melted the connector. Now its shorting out the new one. These headlight assemblies run over $200 each not including installation!
