Do you (or did you) own or lease a model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicle equipped with an N63 engine? You may be eligible to participate in a class action settlement resolving claims the engines consume excessive amounts of oil.

The BMW oil class action was originally filed in September 2015. The group of plaintiffs who filed the case argued that BMW concealed an engine defect which allegedly causes vehicles to consume excessive amounts of motor oil, requiring additional oil changes and the need for adding engine oil between regular oil changes. They further allege the defect causes substantial battery drain, potentially causing premature battery failure.

BMW has denied any wrongdoing in the case but agreed to settle the class action lawsuit to avoid future costs of litigation. Although the settlement proposal did not provide an estimated amount for the settlement fund, plaintiffs’ attorneys said Class Members will receive compensation equal to or greater than what they would have received if they won at trial.

Under the BMW oil class action settlement agreement, eligible Class Members are entitled to a number of benefits, including free future oil service and/or reimbursement for past oil services, reimbursement for towing/rental/roadside-assistance service, and/or reimbursement for a battery replacement.

Class Members have until Aug. 23, 2018 to exclude themselves from the settlement fund and until Oct. 10, 2018 to submit a valid claim. The final approval hearing is set for Sep. 10, 2018.

Who’s Eligible

Class Members include consumers and entities in the United States or Puerto Rico who currently own or lease, or previously owned or leased, certain U.S. specification model-year 2009-2014 BMW 5 series, 6 series, 7 series, X5, or X6 vehicles equipped with an N63 engine purchased or leased in the United States or Puerto Rico.

The following vehicles are covered by this settlement:

  • 7 Series Sedan (F01 & F02), model years 2009 to 2012, produced from 3/2009 to 6/2012
  • 7 Series Active Hybrid (F04), model years 2010 to 2013, produced from 4/2010 to 6/2012
  • 5 Series Gran Turismo (F07), model years 2010 to 2012, produced from 9/2009 to 6/2012
  • 5 Series Sedan (F10), model years 2010 to 2013, produced from 3/2010 to 7/2013
  • 6 Series Convertible (F12), model years 2011 to 2012, produced from 3/2011 to 7/2012
  • 6 Series Coupe (F13), model years 2011 to 2012, produced from 7/2011 to 7/2012
  • X5 SAV (E70), model years 2010 to 2013, produced from 3/2010 to 6/2013
  • X6 SAV (E71), model years 2009 to 2014, produced from 7/2008 to 6/2014
  • X6 Active Hybrid SAV (E72), model years 2009 to 2012, produced from 9/2009 to 9/2011
Potential Award

Class Members who submit a valid claim may be entitled to a number of benefits. The full list of benefits and their details can be found in the FAQ section of the settlement website.

Here is a very high-level breakdown of some of the benefits available, which vary depending on your vehicle’s model year and mileage, and if you have documentation:

  • Three free future oil services, up to $75 per service.
  • Free engine replacement.
  • Reimbursement of past oil services, up to $75.
  • Reimbursement up to $50 for the cost of one towing/rental/roadside assistance expense incurred.
  • Reimbursement for the cost of a replacement battery that was less than 3 years old.
  • Voucher worth $1,000 to $1,500 to be used on a new BMW vehicle.

Proof of Purchase

If Class Members are seeking compensation for additional oil or battery expenses, they must provide a copy of the relevant invoice and a copy of the receipt of payment. The invoice must contain the VIN, mileage, date of service, service provided, and amount due. More information is available in #6 of the settlement administrator’s FAQ page.

    I drive 750Li and my car been losing oil. Valve stem turbo leaking, lines leaking and turbo plates are leaking. The cost was like buying a new motor. Before this Classic BMW reck my car and more problems begin. They return me back a damaged car.. They service manager tell me that my car was old.

      Agreed! Stay far away from this junk! $2500 for a battery, burning over five quarts of oil monthly, windshield washer light on for no reason. German engineering is terrible. Never had problems till i switch to the heavily marketed german vehicle. The smallest claim window i have ever seen.

      Definitely my last german vehicle. They don’t stand by their product. Lying is not standing by your product, it’s lying and not protecting the people that buy your product.

    I own a 535i xdrive. Repairs have been a fortune….In the shop once every 6 -12 months the last 2 and a half yrs. So much money sunk in parts, repairs etc. BMWS Are a piece of shit and cost a fortune to buy plus a fortune to MAINTAIN..

    I bought a used 550i GT 2011 just last year, I have to refill a quart of oil every two weeks. I don’t have any battery problems but I’m spending a ton on full synthetic oil. I haven’t had to be towed because I’ve paid attention to the oil levels and refilled it appropriately. Since I’m changing so much oil, I’m not even sure if I need an oil change. Can I be included in this Class Action Lawsuit?

    I’m total disgusted in my 2011 750i .. Drinks oil and i have to add a quart every week! Took it to BMW they stated had a internal leak and to fix will be around 3000. Got it fixed and it’s still doing the same thing.. something is definitely not right by the engine or something..

        Same here, I have a 750LI and it drinks oil like crazy. Found out that my head is cracked. Been at the dealer for over 3 months now. This is the last time I will purchase one of these vehicles and this is my 4th BMW. They need to build a better product and just fix the problems.

    I took my 2012 bmw x5 for an oil change and ask why it was using oil between oil changes. The service manager they all do that,it’s normal. I also had to purchase a battery due to it not holding a charge. I bought a battery at Sam’s Club and traded it in for a new mazda.

    Extremely disgusted at the purchase of a used 07’ BMW X5…smokes like a chimney on idle and was NOT disclosed this before I bought it. Was told it was 6K to fix but have had extensive service on it since then and have had issue after issue. I’m stuck. Warranty I bought is crap as well as they KNOW the Valve stem Seals need replacement and they don’t want to pony up on it, even THO it’s covered under contact.

    I own a 2006 BMW 750LI Sport that is still in really nice shape. Always garaged. Has 155k miles. It smokes like a locomotive if I let it idle at stop lights ect. I have to add a quart of oil every 500 Miles. I got stuck on I40 in Oklahoma where I reside and was driving like 10 mph for an hour. The smoking was not
    Only totally redickolous it was so embarrassing for me to be driving such an exspencive car and people thinking WOW if that’s a BMW 750LI that thing is a total piece of shit!! I asked around and they said it was $6000 to change the valve seals. I am so disgusted that I even own the damn thing that I can’t even hardly give away. Who wants to sell their car and telling the buyer well it smokes when ya let it idle and you have to add oil every 500 Miles? I’m sure I’ll get rid of it soon at this rate!!! BMW needs to fix my damn car!!! Shouldn’t cost me anything!!!! Is there anything I can do?? Thanks!

      Me too!! I have 2006 BMW 750i that has cost me over 7k to fix and still smoking and quart every 700 miles.
