Bank of America agreed to a $8 million settlement to resolve a class action lawsuit claiming it charged unfair overdraft and non-sufficient funds (NSF) fees on checks. 

The settlement benefits Bank of America customers who were not refunded an NSF and/or overdraft fee in connection with a reprocessed check or ACH entry. 

According to the class action lawsuit, Bank of America charged multiple NSF fees and overdraft fees assessed on check transactions. Plaintiffs in the case say these fees violate Bank of America’s fee policies. 

Bank of America is a national bank chain that offers various financial products, including checking and savings accounts. 

Bank of America hasn’t admitted any wrongdoing but agreed to an $8 million settlement to resolve the bank fees class action lawsuit.

Under the terms of the Bank of America NSF fees settlement, class members can receive a proportional share of the net settlement fund based on the amount they were assessed in 

The deadline for exclusion and objection is June 24, 2023.

The final approval hearing for the settlement is scheduled for July 24, 2023.

No claim form is required to benefit from the settlement. Class members who do not opt out will automatically receive a settlement payment.

    I received a settlement check but I mistakenly threw it out and I was told by BOA to contact the settlement admin at 888-771-2047 but no one answer the phone. BOA said they were unable to re-issue the check. Who can I contact since the information provided is a dead end?

    Hi I am a victim of bank of America and them charging me fees for checks I tried to deposit but then they wouldn’t when the checks were good and then they would take the amount of the check out of my account when they never add that amount to my account balance and on top of that they’d charge me a fee and also they were taking money from my savings without me asking them to and they’d charge me another fee for that I live in Tucson az and they took at least 10 grand from me what can I do about this my name is Kathy clark and my email is katlynnclark1979@gmail.com I really would appreciate it if I could get some help or advice on what to do about this matter.

    With boa for 16 years for nothing , no benefits.! Please add me to this class action lawsuit. I have many nsf overdraft fees and unauthorized charges and accounts and it’s a whole mess . My credit has taken a plunge and I am in constant stress it’s making me physically I’ll and emotional wreck cause I can’t keep up with all these bills and fees.

    I was a customer with Bank of America starting in 1987 with a Checking & Saving but ended up closing out my account in 200? due to excessive late fees and NSF drafted from my accounts before contacting me first. I was wondering if I qualify for the lawsuit. I was under the impression they would contact me to inform me of my eligibility of being included in this lawsuit. However, since they didn’t contact me, I decided to contact you all to see if I a included. Thank you in advance for your understanding and prompt response.

    Hello, my name is Felipe Parra and I am writing to present my case and request help. This happened in August 2021 when the crisis was hitting hard, I decided to look for a personal loan to help me with the expenses since my wife gave birth to my son two months before, well I applied for a loan online for which I received a call saying that it had been approved that they would send me a text message to continue with the application, I received the message with a link saying that I had to link my bank account for the transfer, enter my username and password and finish with my information, they call me again saying that They would make three small transfers before the loan was deposited into my account and if there were 3 new transfers, the person who called me asked me to return the money through Zelle and gave me a phone call and asked me to make a transfer for the amount of 260 dollars and I made it, they asked me to make one more and that’s where I read the origin of the three transactions, they were payment claims that I had made and the bank was returning the money, I immediately moved the remaining money from my account and contacted the bank of America I explained to a person who attended me that person told me you have just been a victim of scam for which he changed my username he asked me to create a new password and opened a new bank account for me he told me he would leave a note explaining what happened and to call the fraud department. I did it but in that department they did not understand me, they thought that I was claiming as fraudulent the claims that the impostor made, which led to the judgment being against me. They withdrew the money from me on October 1st, leaving my negative account. I deposited an approximate amount of 2,145 from October 4 to November 4, which with the 260 that was stolen would be approximately 2,405 because of that money I never had anything since everything went in charges draft that the bank put before me and even when the account was frozen, each time my automatic payments made a transaction they charged me 35 dollars and 35 dollars more when the bank returned the money to itself in repeated ovations during the month of October and November, I reopened the claim and they failed me again saying that I gave consent that I made the transfer through zelle, they also told me that if I had left the rest of the money in the account my version would be credible, who leaves the money to bandits if they are attacking me stealing I rescue it. I told them that it was not possible for a bank as big as them to have such a lack of experience as they are going to say that I was when another person posing as calls them and makes claims on my behalf what kind of bank gives my money to other people. They sent me a data sheet that I had to fill out I called them I told them to send it to me in Spanish they told me that if I never received it they ruled against me again I called them saying that I did not receive the sheet in Spanish they told me to translate it on Google or pay someone to do it we don’t have those documents in Spanish that was all I decided to leave that for since I had been fighting for 5 months. During those months, my credit card payments were not made, which caused me a greater debt, my credit ended in 379 months where I had to ask for money at high interest rates to be able to put food on the table because my baby was newborn and it was frustrating to hear him cry and not be able to explain to him what was happening, he was just hungry and that broke me into a thousand pieces. My financial life changed completely. I spent hours on the phone and was never heard in the middle of the pandemic. I hope you can help me, I just found out that there is a class action lawsuit for people who suffered the same thing as me at that same institution, I want my peace of mind and my life back.
