Audi engine defect class action lawsuit

On May 29, a California federal judge granted final approval to a class action lawsuit settlement with Volkswagen and Audi over claims they sold nearly 126,000 vehicles that consumed excess engine oil.

If you purchased or leased a 2009-2011 model year Audi 4, Audi A5 or Audi Q5 vehicle, you may be included in the class action settlement and be eligible to claim a number of benefits, including free repairs, an extended warranty and reimbursement for out-of-pocket expenses.

The Audi oil consumption settlement resolves a 2012 class action lawsuit (Asghari v. Volkswagen Group of America Inc.) that claimed certain 2009-2011 Audi vehicles contained engine defects “that cause them to burn off and/or consume abnormally high amounts of oil.”

The Audi engine class action lawsuit was transferred to federal court in Central California at the request of Audi and Volkswagen and later combined with other similar class action lawsuits, adding additional lead plaintiffs.

Some of the allegations were dismissed in a November 2013 decision.

Audi and Volkswagen deny the allegations and any wrongdoing but agreed to a class action settlement in September 2014 to resolve the litigation.

U.S. District Judge Margaret M. Morrow preliminarily approved the deal on Oct. 16, 2014 and later granted final approval on May 29, 2015.

Who’s Eligible

The Audi oil consumption settlement covers all purchasers and lessees, in the United States and Puerto Rico, of the following vehicles originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB (“CAEB engine”):

  • 2009 model year Audi A4
  • 2010 model year Audi A4 or A5
  • 2011 model year Audi A4, A5 or Q5

Potential Award

Varies. The Audi oil class action settlement provides a number of benefits to qualifying Class Members:

    • Reimbursement for the following service adjustments performed by an authorized Audi dealer prior to Jan. 28, 2015:
      • (1) a replacement of the crankcase pressure regulating valve, front crankshaft seal and front crankshaft bolt, and (2) updating of the Engine Control Module software to match the new part(s).

To receive a cash reimbursement, you must submit a valid Claim Form and supporting documents by June 27, 2015.

      • Free service adjustment for current owners or lessees of Settlement Class Vehicles within 18 months after Jan. 28, 2015.
      • Warranty extension from 4 years/50,000 miles to 8 years/80,000 miles to cover any repair needed to correct excessive engine oil consumption, by an authorized Audi dealer.
Proof of Purchase

The following documentation must be submitted with your Claim Form in order to receive a reimbursement of out-of-pocket expenses for a covered service adjustment:

      • The date and vehicle mileage at the time of the Service Adjustment;
      • The name, address and telephone number of the Audi dealer that performed the Service Adjustment;
      • The year, make, model and Vehicle ID Number (VIN) of your vehicle;
      • Proof of ownership or lease of the vehicle;
      • A description of the work performed, including a breakdown of the parts repaired or replaced and the parts and labor costs;
      • Proof of payment including the amount paid for the Service Adjustment (parts and labor) and the date and manner of payment;
      • If you were previously reimbursed in part for the Service Adjustment, the amount of the reimbursement, and when, how and by whom you were partially reimbursed.

    Audi Q5 2012. Oil consumption too high. I took the car to the dealer and they gave me a report where they explained that it needed to change the vacuum pump gasket and camshaft cover/carrier reseal. I need to put one Quoter of oil every 500 miles plus…Is there a class action in the USA???

      I am having similar problem with 2012 Q5 that has 86K miles. Dealer performed oil consumption test and it burns about 1qt every 1K miles. After they performed additional tests they are now recommending changing pistons and rings for $10K, or if they find scratches on piston walls after tear down, a new engine for $19K. I called Audi USA and was told they would cover 25% of cost for new pistons/rings but would not offer anything at this point for engine replacement since that is not the current diagnosis. I am currently waiting for call back from a “Supervisor” to discuss further. The car is currently only worth $8-10K. After reading the thread on this site it appears that another class action may be in order. Definitely my last Audi!

    Bought a 2012 A4 for our 18 yr. old and we are putting a quart of oil in every week- every 190 miles or so. Two weeks after purchasing, Audi dealership put the car thru 2 oil consumption tests and now they want $6000 to replace the pistons. Do we have any ground to stand on since we bought it used? Any recommendations?

    Additionally, the fact that Audi is continually pushing consumers to have oil consumption testing done on models that have already previously been identified and addressed in the claim previously addressed by the class action lawsuit seems unfiting. I am suspect as to why this protocol is still relevant and taking place if in fact there has already been proof that this is an issue? Sounds to me as if the company is hiding this claim in hopes that their consumers do not recognize. Unfortunately, many have fallen victim to their scandal. So again, I plea and seek justification for that of Audi’s neglect and ignorance to force consumers to continue to pay out of pocket for their faulty product seems cruel and again unjust. How can we as consumers be alleviated from their beguile ?

    I am wondering if there is a way in which to reopen this claim. Seems to me through various research that many of the more recent comments in regards to this issue are that current owners who have missed this deadline have not been formerly warned or informed about this issue. I like many of these owners have also been misinformed and or not informed at all. Yet, instead the only options offered by Audi USA have only been to the benefit of the company and not to the consumers who make this company a success. That is, the conclusions from Audi USA more expenses on my behalf for Audi’s misleading claims. What is worse is that during the time of my complaints, oil consumption testing and even the occurence of my life potentially being at risk due to, the lack of Audi USA and their employees ignorance, said claims around oil consumption issues was by large refined to terms “spark plugs and fuel pump issues”. Even as this, there was no mentioned to me that there was a lawsuit in place even at the time or in former during my proceedings.Go figure. I saw there was some 2 billion (may not be accurate but in this range) dollars that was opened for this class action lawsuit that audi still refused to recognize but settled anyway! Again, GO FIGURE.. I HIGHLY DOUBT the 126,000 cars sold to owners with this malfunction were notified of this claim. In closing, again I want to address this persistent neglect by Audi and am curious like others if this is a possibility to reopen the claim for those of us who were never informed? How is this justified?

        I owned a Audi 2011 A6 that has the oil consumption problem and I told the Dealer several months after I bought it and they told it was ok. My car was not included in the class action lawsuit. There are more out there with the same problem.

    My 2011 Audi Q5 is impacted. Dealer has done Stage 1 fix for free but now car is even worse.
    To make things worse Audi is refusing to pay for Stage 2 stating that it is outside of 8 year extended warranty. What do I do ?

    I have a 2010 Audi A4. It’s consumes large amounts of oil and I’m adding a liter every 500 miles on average. There are no signs of a leak anywhere.

    To whom this may concern, I am South Africa and I own an Audi 2012 A6 2.0 TFSI, my vehicle uses 400ml of oil every 217miles. I had a complete “Oil Consumption Test” done to my vehicle at Audi Cape Town free of charge, and I received a quote of R71 000K for the repairs. I am still within the 8years, with complete Service History done. What are my chances of having this repair done at Audi cost? Although its a 2012 the vehicle is a late 2011.

      Hi Joseph, I too reside in South Africa and am experiencing the same issue on an A4 2011. Have you found a resolve? Would like to link up I think this could be a great story for Carte Blanche. As there are many others that have been experiencing the same issue.

    I have a 2009 Audi A4. It’s been consuming oil for about two years now. I be scratching my head over what the deal is. I don’t use it as much as I’d like to because of this. Is there anything I can do at this point! I’m furious that there’s no recall!
