Audi engine defect class action lawsuit

On May 29, a California federal judge granted final approval to a class action lawsuit settlement with Volkswagen and Audi over claims they sold nearly 126,000 vehicles that consumed excess engine oil.

If you purchased or leased a 2009-2011 model year Audi 4, Audi A5 or Audi Q5 vehicle, you may be included in the class action settlement and be eligible to claim a number of benefits, including free repairs, an extended warranty and reimbursement for out-of-pocket expenses.

The Audi oil consumption settlement resolves a 2012 class action lawsuit (Asghari v. Volkswagen Group of America Inc.) that claimed certain 2009-2011 Audi vehicles contained engine defects “that cause them to burn off and/or consume abnormally high amounts of oil.”

The Audi engine class action lawsuit was transferred to federal court in Central California at the request of Audi and Volkswagen and later combined with other similar class action lawsuits, adding additional lead plaintiffs.

Some of the allegations were dismissed in a November 2013 decision.

Audi and Volkswagen deny the allegations and any wrongdoing but agreed to a class action settlement in September 2014 to resolve the litigation.

U.S. District Judge Margaret M. Morrow preliminarily approved the deal on Oct. 16, 2014 and later granted final approval on May 29, 2015.

Who’s Eligible

The Audi oil consumption settlement covers all purchasers and lessees, in the United States and Puerto Rico, of the following vehicles originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB (“CAEB engine”):

  • 2009 model year Audi A4
  • 2010 model year Audi A4 or A5
  • 2011 model year Audi A4, A5 or Q5

Potential Award

Varies. The Audi oil class action settlement provides a number of benefits to qualifying Class Members:

    • Reimbursement for the following service adjustments performed by an authorized Audi dealer prior to Jan. 28, 2015:
      • (1) a replacement of the crankcase pressure regulating valve, front crankshaft seal and front crankshaft bolt, and (2) updating of the Engine Control Module software to match the new part(s).

To receive a cash reimbursement, you must submit a valid Claim Form and supporting documents by June 27, 2015.

      • Free service adjustment for current owners or lessees of Settlement Class Vehicles within 18 months after Jan. 28, 2015.
      • Warranty extension from 4 years/50,000 miles to 8 years/80,000 miles to cover any repair needed to correct excessive engine oil consumption, by an authorized Audi dealer.
Proof of Purchase

The following documentation must be submitted with your Claim Form in order to receive a reimbursement of out-of-pocket expenses for a covered service adjustment:

      • The date and vehicle mileage at the time of the Service Adjustment;
      • The name, address and telephone number of the Audi dealer that performed the Service Adjustment;
      • The year, make, model and Vehicle ID Number (VIN) of your vehicle;
      • Proof of ownership or lease of the vehicle;
      • A description of the work performed, including a breakdown of the parts repaired or replaced and the parts and labor costs;
      • Proof of payment including the amount paid for the Service Adjustment (parts and labor) and the date and manner of payment;
      • If you were previously reimbursed in part for the Service Adjustment, the amount of the reimbursement, and when, how and by whom you were partially reimbursed.

    Can anyone tell me if this is still possible to claim? I have a 2009 Audi A4 that consumes a lot of oil sense i bought the car. I know have 135,000 miles on the car and it seems to be having issues due to the oil consumption problem . I bought the car used from CarMax and they never said anything about which they probably had no idea because this is not listed as a recall. So any information on this would be great as my car needs to go into the shop for repairs.

    I am having the same problem but my car is a 2012 Q5. Dealership denies any assistance for my vehicle that had been consuming a quart of oil every week. The car has under 80K.

    I own a 2010 Audi a5 2.0T and am experiencing oil consumption issues. I called the corporate audi/vw number and they indicated that my car has never had an open recall. How can they have a time frame on the oil consumption issue and not an open recall for any vehicle experiencing this issue?

    I have a 2011 A4 and have been adding a quart every 4 weeks. Bought car in 2015 from local Audi dealer with 40,000 miles and now have 135,000 so I think I’m beyond any warranties.
    If the car has always been maintained by the dealer I bought from (both for previous owner and me) and dealer must have known of the issue when it sold to me in 2015, what would my best argument be?

    is there anything new pertaining to this situation? my dealership gave me the run around before my car had 80k on it and now it is over 80k. I’m surprised that there is no recall. I want to pay for the so called “fix” but apparently I will be in the same situation I’m in now after another few thousand miles. Between each oil change i put at least 5 of the big jugs of oil. I already made a case with audi but i do all the maintenance on my car on my own so i have no validating paperwork. if anyone has any new info regarding what options i have that would be greatly appreciated shanemate8@gmail.com

    I just paid $430 as my 10% share to fix the oil consumption problem on a 2010 A5 56k mi. I was under the impression the extension would have taken me to this year. The 10% was because I missed the warranty extension date, kidding right. It gets better I was asked if while this was being done I wanted to replace the timing chain/sensor because they have been having issues. It did show wear when repairing the oil issue but they want me to pay $350 to change a car with just 56k mi. I can seem to verify if this problem has also been settled with VW. This was on top of problems with my A4 and the 3 ignition coil wires failing but at that time Audi would only replace them when they failed. Where do you think that usually happened! Guess shame on e for buying another one of their products.

    I have same problem here in Mexico with an Audi A4 2011 1.8 lts, 73000 KM = 45,600 Miles
    Do you know how can I make valid this extended warranty in Mexico? , any contact and supporting material I can use for my claim here?
    The quotation I got from the dealer is $89,000 Mxn pesos , equivalent to $4,800 usd.

      HAVE AUDI A 4 AND I HAVE BEEN HAVING THE SAME PROBLEMS WITH OIL CONSUMPTION . IF THERE ARE ANY ALTERNATIVES THAT HAVE BEEN FOUND TO SOLVE THIS PROBLEM. LET ME KNOW. HAVE BEEN GETTING THE RUN AROUND FROM THE AUDI DEALER IN ST LOUIS AND THEY DON;T WANT TO BE RESPONSIBLE FOR FIXING THE ISSUE . ANY ANSWERS OUT THERE WOULD BE GREATLY APPRECIATED. MY CAR IS A 2009 A 4 AND IT USES OIL AT AN ACCELERATED RATE . .

        Please read my comments below but if the dealer is giving you a hard time you state that your car falls under the 8/80 warranty (8 years or younger and under 80,000 miles). There is also what’s called a “93A” which is a consumer protection letter from the attorney general (check for your state) and you can print out an example letter with instructions. This can be sent to Audi direct for damages.

        and ok
        the piston used are the lower oilring can brake
        because a gap in dthe iston design at the wirst pin

      If you own an Audi that is listed above (year,model) you need to bring your car to an Audi Authorized dealer and they will,ask you to do an “Oil Consumption” test. They will monitor how much oil the car is burning. You may have to go back 3/4vtimes. Please make sure you mention this class action and that your car falls under the “8/80”. That means that your car is 8 years or younger and/or under 80,000 miles on the odometer. My car was burning a quart every 100 miles. They did the consumption test and repaired the piston and rings. This problem can lead to other major problems as well so the sooner the better.

        You can also send a letter to Audi direct. 93A it’s called from Consumer Protection and they have example letter online you can print out with instructions on how to send it. Do not let them give you the run around. Call Audi and report the dealership. Hope my comments help.

        I own a B8 2010 AUDI S4 and they said the warranty ended end of 2017. They said all costs have to be covered OUT OF POCKET. I bought this car in Nov. of 2018 from the dealer and they did not mention any problems to me. Where do I stand now and I am student so I do not have the money to put into this car. I called my local AUDI dealer and AUDI USA. Both say 80/80,000 rule does not apply here and they cannot help. What would be my next step, can someone please help? I am burning 1qt every 100 miles, the same as you APRIL.

    After a week at the dealership I decided to go with a low miles used engine. Audi would not cover the cost of the new engine and was initially quoted close to $13K including labor, that’s more than what the car’s worth. The dealership tried to work with Audi and got the price down to just over $7K but that was still high for me. Their new engine warranty would only cover 1-year or 12K miles, which is the same coverage I get with the used engine so it doesn’t make sense to me to go with Audi. The total cost of the used engine with installation comes to $3,400. The plan is to trade Q5 for something other than Audi. It’s ashamed that a prestige auto maker would not back their product, they are well aware of the oil consumption issue with this model and year but not willing to take responsibility. This was out first and last Audi. Best of luck to everyone else in the same situation!
