Audi engine defect class action lawsuit

On May 29, a California federal judge granted final approval to a class action lawsuit settlement with Volkswagen and Audi over claims they sold nearly 126,000 vehicles that consumed excess engine oil.

If you purchased or leased a 2009-2011 model year Audi 4, Audi A5 or Audi Q5 vehicle, you may be included in the class action settlement and be eligible to claim a number of benefits, including free repairs, an extended warranty and reimbursement for out-of-pocket expenses.

The Audi oil consumption settlement resolves a 2012 class action lawsuit (Asghari v. Volkswagen Group of America Inc.) that claimed certain 2009-2011 Audi vehicles contained engine defects “that cause them to burn off and/or consume abnormally high amounts of oil.”

The Audi engine class action lawsuit was transferred to federal court in Central California at the request of Audi and Volkswagen and later combined with other similar class action lawsuits, adding additional lead plaintiffs.

Some of the allegations were dismissed in a November 2013 decision.

Audi and Volkswagen deny the allegations and any wrongdoing but agreed to a class action settlement in September 2014 to resolve the litigation.

U.S. District Judge Margaret M. Morrow preliminarily approved the deal on Oct. 16, 2014 and later granted final approval on May 29, 2015.

Who’s Eligible

The Audi oil consumption settlement covers all purchasers and lessees, in the United States and Puerto Rico, of the following vehicles originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB (“CAEB engine”):

  • 2009 model year Audi A4
  • 2010 model year Audi A4 or A5
  • 2011 model year Audi A4, A5 or Q5

Potential Award

Varies. The Audi oil class action settlement provides a number of benefits to qualifying Class Members:

    • Reimbursement for the following service adjustments performed by an authorized Audi dealer prior to Jan. 28, 2015:
      • (1) a replacement of the crankcase pressure regulating valve, front crankshaft seal and front crankshaft bolt, and (2) updating of the Engine Control Module software to match the new part(s).

To receive a cash reimbursement, you must submit a valid Claim Form and supporting documents by June 27, 2015.

      • Free service adjustment for current owners or lessees of Settlement Class Vehicles within 18 months after Jan. 28, 2015.
      • Warranty extension from 4 years/50,000 miles to 8 years/80,000 miles to cover any repair needed to correct excessive engine oil consumption, by an authorized Audi dealer.
Proof of Purchase

The following documentation must be submitted with your Claim Form in order to receive a reimbursement of out-of-pocket expenses for a covered service adjustment:

      • The date and vehicle mileage at the time of the Service Adjustment;
      • The name, address and telephone number of the Audi dealer that performed the Service Adjustment;
      • The year, make, model and Vehicle ID Number (VIN) of your vehicle;
      • Proof of ownership or lease of the vehicle;
      • A description of the work performed, including a breakdown of the parts repaired or replaced and the parts and labor costs;
      • Proof of payment including the amount paid for the Service Adjustment (parts and labor) and the date and manner of payment;
      • If you were previously reimbursed in part for the Service Adjustment, the amount of the reimbursement, and when, how and by whom you were partially reimbursed.

    After regular services, only 55,000 miles and years of excessive oil consumption, my 2014 Audi TT has died – engine failure. I am now having to have it towed home from the mechanic to sit in nonoperation. Definitely feeling duped by Audi.

    I have an Audi A5.. my car has been consuming so much oil, I was putting it in weekly. Which caused other problems.

      I bought my 2011 A5 in 2012 and have had it ever since, the first time I added oil was approximately 7 months after purchase but I thought nothing of it and after that once a year for the next 4 years but then the time in between having to add oil started to decrease, only by a couple of months at first but I approached my mechanic and he suggested a new sensor which we tried and it seemed to work for a while but then started to get worse. In the last 2/3 years I have changed the oil sensor 3 times added a oil dipstick and changed the turbocharger which has had no effect. Now I can put a litre of oil in and drive 25 miles and have to add more oil.

      I bought a 2011 Audi Q5 April 2022 currently it has started burning one quart of oil a week and I see problems coming I can’t afford to buy a new motor after it fails and it will now that I have done my research 1 month after buying the car I wrote letters to the dealer about reading all the lawsuits that I knew nothing about, my bad……. No response nothing I just continue to take very good care of it with oil and never running it low and running it cleaning but now no matter what I do to the oil it’s going to be a problem I see it coming I asked them to address it one month after purchase and also concerns with the other lawsuits against Audi

    I have a 2009 Audi A4 with less than 60,000 miles and am adding oil almost twice a week. Is there another class action lawsuit happening? This is ridiculious and I’m afraid to drive the car anywhere. It’s unreliable.

    Is burning 1 qt of oil every 120k
    I’ve owned car for 1 week an half and I’ve added 3 qts of oil so every 3 days I’ll have to add oil since I’m using for Uber and Lyft

    I Own a 2012 Audi Q5 from the first day i purchased the SUV from a use car dealer it consumed a quart of oil after a 100 to a 150 miles .this is ridiculous Audi refuses too stand behind their product. if a new lawsuit is open I would like to be included can someone please keep me informed

      On 11/29/2021: I second that!!! Just recently bought a well maintained 2015 Q5 and same problem. I can’t believe that AUDI has let it’s quality standards fall to such lows. Literally vaporizing oil. HORRIFIC…for the environment AND my wallet !! From a first generation German family, I have ALWAYS been proud of German Made/Engineered products …until now. PLEASE PLEASE PLEASE AUDI of AMERICA….please make the right choice….stand behind ALL of your products!

    I have a 2010 Audi A4, it’s been consuming oil ever since 73K now 134K i’m adding oil twice a month. Back in 2015, I called some number about a class action lawsuit was given the run around. I love VW and Audi’s but I am not happy how they handle recalls. My first Ever Brand new VW Jetta 2006 was a lemon and dealing with the dealer was great but getting another car was impossible they refused and inconvenienced us many times as the car broke down before fixing it to manufactor specs.

    2011 A4 with oil consumption issue just like everyone else. Dealer did Step 1 and asked me to return. Told me $6000 for engine work. I was never notified of class action though I’ve owned the car since 2012. Any recovery available now?
