Audi engine defect class action lawsuit

On May 29, a California federal judge granted final approval to a class action lawsuit settlement with Volkswagen and Audi over claims they sold nearly 126,000 vehicles that consumed excess engine oil.

If you purchased or leased a 2009-2011 model year Audi 4, Audi A5 or Audi Q5 vehicle, you may be included in the class action settlement and be eligible to claim a number of benefits, including free repairs, an extended warranty and reimbursement for out-of-pocket expenses.

The Audi oil consumption settlement resolves a 2012 class action lawsuit (Asghari v. Volkswagen Group of America Inc.) that claimed certain 2009-2011 Audi vehicles contained engine defects “that cause them to burn off and/or consume abnormally high amounts of oil.”

The Audi engine class action lawsuit was transferred to federal court in Central California at the request of Audi and Volkswagen and later combined with other similar class action lawsuits, adding additional lead plaintiffs.

Some of the allegations were dismissed in a November 2013 decision.

Audi and Volkswagen deny the allegations and any wrongdoing but agreed to a class action settlement in September 2014 to resolve the litigation.

U.S. District Judge Margaret M. Morrow preliminarily approved the deal on Oct. 16, 2014 and later granted final approval on May 29, 2015.

Who’s Eligible

The Audi oil consumption settlement covers all purchasers and lessees, in the United States and Puerto Rico, of the following vehicles originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB (“CAEB engine”):

  • 2009 model year Audi A4
  • 2010 model year Audi A4 or A5
  • 2011 model year Audi A4, A5 or Q5

Potential Award

Varies. The Audi oil class action settlement provides a number of benefits to qualifying Class Members:

    • Reimbursement for the following service adjustments performed by an authorized Audi dealer prior to Jan. 28, 2015:
      • (1) a replacement of the crankcase pressure regulating valve, front crankshaft seal and front crankshaft bolt, and (2) updating of the Engine Control Module software to match the new part(s).

To receive a cash reimbursement, you must submit a valid Claim Form and supporting documents by June 27, 2015.

      • Free service adjustment for current owners or lessees of Settlement Class Vehicles within 18 months after Jan. 28, 2015.
      • Warranty extension from 4 years/50,000 miles to 8 years/80,000 miles to cover any repair needed to correct excessive engine oil consumption, by an authorized Audi dealer.
Proof of Purchase

The following documentation must be submitted with your Claim Form in order to receive a reimbursement of out-of-pocket expenses for a covered service adjustment:

      • The date and vehicle mileage at the time of the Service Adjustment;
      • The name, address and telephone number of the Audi dealer that performed the Service Adjustment;
      • The year, make, model and Vehicle ID Number (VIN) of your vehicle;
      • Proof of ownership or lease of the vehicle;
      • A description of the work performed, including a breakdown of the parts repaired or replaced and the parts and labor costs;
      • Proof of payment including the amount paid for the Service Adjustment (parts and labor) and the date and manner of payment;
      • If you were previously reimbursed in part for the Service Adjustment, the amount of the reimbursement, and when, how and by whom you were partially reimbursed.

    I have recently bought 2009 Audi A4 Quattro and have added oil to the car about 3 times in the past three weeks. Is there anything I could do? I can’t even get more than 300 miles on 4.5 qts of oil.

      Recently bought an Audi 2011 Q5 for my son for his 16th birthday. He put his own money into the car that he saved up and now we are fighting with Audi about the oil consumption problem. It has been at the dealership where we purchased it for over 10 days now bc they said it is not covered anymore and are expecting us to pay. We first brought it to their attention a few days after we bought the car and they swore they checked it out and there was nothing wrong. Anyone having any luck getting this issue taken care by Audi? Super disappointed in the way Audi is denying wrong doing.

        Audi dealerships are a bunch of clowns. They’ll charge you $250 for an oil consumption test. Then you need to come back to do another test when the car calls for more oil. The repair is about 7k. I’m frustrated with Audi because I lost value on my car. I can’t honestly sell it due to this problem. I’ll have to trade it in and buy a new car which I didn’t want to do. I’m through with Audi and will tell others not to buy them as well. I feel like it’s a fraud because they know of the problem. The problem exists on all those cars and they won’t fix them. That’s what a recall is for. Too expensive I understand but not at the expense of losing customers.

    I purchased new 2013 Audi Q5 2.0T Prem Tip qtro Serial #WA1LFCFP9DA011686 on Oct 31-2012 in Calgary Alberta Canada. after running 75,000kM it started burning oil and I have to add engine oil between the scheduled service. Is it covered under any warranty or class action suit.

    I just purchased a 2011 Audi A4 Quattro the end of May. Since then, I’ve had to put about 3 quarts of oil in it. I am just finding out about the suit. Would my car be covered or am I just out of luck?

    I have a 2010 Audi A5 2Lt quarto. Audi Australia have tested and agreed it has the oil consumption problem due to underperforming rings. This was recalled in Europe but Audi will not honour the recall in Australia.
    Please advise if there is a course of action I can take. Is there a class action in Australia?

      I purchased my gently used 2012 Q5 2.0 July 2017.
      First I delt with the timing tensioner and chain issues, out of pocket, but have been informed my claim for that is in work, and valid.
      I handeled that just after buying the Q. After that work with oil change I noticed some consumption, but didn’t think much of it.
      But now I service it with oil 5/40 every week. Total bull shit. Great car, but looking for a remedy from Audi/ VW.
      I have another 2.0 that I check but never add oil until it time to change it.

    So i bought this 2010 audi from a volvo dealer on february of 2019 and i did complain about the low oil light being on….and they assured me they would fix it…made the purchase….took the car back twice….they never fixed it….what do i do????i have put 1600 miles on the car and has not even a drop of oil in it

    Angelica – the Class action Oil Consumption lawsuit was filed May 1, 2012 in California Central District Court. What year did you buy your Audi A5 2.0 T? 2011 or 2012?
    The engine identification code CAEB is factory installed and named in the Class Action settlement. Does you car have the factory installed “CAEB” engine?

    Same problems also. Check to see if the car was manufactured in 2011 and if the Audi internal engine code is “CAEB”. Should be a sticker in the Warranty manual with the engine code “CAEB”.

      I’ve had my oil check a twice times over the Years.. each time the oil consumption ‘barely passed’ but now it seems much worse.. but the case has been closed! Not happy with Audi

    Just took Audi 2012 A5 with 2.0 TFSI engine – identification CAEB to dealer this morning due to one quart oil consumption every +/- 400 miles. This was the same engine that was consuming oil in the Audi Oil Consumption Class Action lawsuit settlement for model years up to 2011. The car was manufactured in 2011 with the same 2.0 TFSI engine with Audi internal engine code CAEB, but was left out of the class Action Settlement. The Audi 2012 A5 would still be under warranty if the Audi 2012 A5 manufactured in 2011 was included in the settlement. Are there any other Class Actions against AUDI for vehicles with Audi internal engine code CAEB that were excluded from the Audi Oil Consumption Class Action Lawsuit Settlement that were manufactured in 2011?
