Audi engine defect class action lawsuit

On May 29, a California federal judge granted final approval to a class action lawsuit settlement with Volkswagen and Audi over claims they sold nearly 126,000 vehicles that consumed excess engine oil.

If you purchased or leased a 2009-2011 model year Audi 4, Audi A5 or Audi Q5 vehicle, you may be included in the class action settlement and be eligible to claim a number of benefits, including free repairs, an extended warranty and reimbursement for out-of-pocket expenses.

The Audi oil consumption settlement resolves a 2012 class action lawsuit (Asghari v. Volkswagen Group of America Inc.) that claimed certain 2009-2011 Audi vehicles contained engine defects “that cause them to burn off and/or consume abnormally high amounts of oil.”

The Audi engine class action lawsuit was transferred to federal court in Central California at the request of Audi and Volkswagen and later combined with other similar class action lawsuits, adding additional lead plaintiffs.

Some of the allegations were dismissed in a November 2013 decision.

Audi and Volkswagen deny the allegations and any wrongdoing but agreed to a class action settlement in September 2014 to resolve the litigation.

U.S. District Judge Margaret M. Morrow preliminarily approved the deal on Oct. 16, 2014 and later granted final approval on May 29, 2015.

Who’s Eligible

The Audi oil consumption settlement covers all purchasers and lessees, in the United States and Puerto Rico, of the following vehicles originally equipped with a factory-installed 2.0 liter TFSI longitudinal engine bearing Audi internal engine code CAEB (“CAEB engine”):

  • 2009 model year Audi A4
  • 2010 model year Audi A4 or A5
  • 2011 model year Audi A4, A5 or Q5

Potential Award

Varies. The Audi oil class action settlement provides a number of benefits to qualifying Class Members:

    • Reimbursement for the following service adjustments performed by an authorized Audi dealer prior to Jan. 28, 2015:
      • (1) a replacement of the crankcase pressure regulating valve, front crankshaft seal and front crankshaft bolt, and (2) updating of the Engine Control Module software to match the new part(s).

To receive a cash reimbursement, you must submit a valid Claim Form and supporting documents by June 27, 2015.

      • Free service adjustment for current owners or lessees of Settlement Class Vehicles within 18 months after Jan. 28, 2015.
      • Warranty extension from 4 years/50,000 miles to 8 years/80,000 miles to cover any repair needed to correct excessive engine oil consumption, by an authorized Audi dealer.
Proof of Purchase

The following documentation must be submitted with your Claim Form in order to receive a reimbursement of out-of-pocket expenses for a covered service adjustment:

      • The date and vehicle mileage at the time of the Service Adjustment;
      • The name, address and telephone number of the Audi dealer that performed the Service Adjustment;
      • The year, make, model and Vehicle ID Number (VIN) of your vehicle;
      • Proof of ownership or lease of the vehicle;
      • A description of the work performed, including a breakdown of the parts repaired or replaced and the parts and labor costs;
      • Proof of payment including the amount paid for the Service Adjustment (parts and labor) and the date and manner of payment;
      • If you were previously reimbursed in part for the Service Adjustment, the amount of the reimbursement, and when, how and by whom you were partially reimbursed.

    I have a 2011 Q5 2.0T and the oil consumption started around 75k miles, I’be been adding a quart of oil every 2 weeks or so. I am now at 87k and the engine seized few weeks ago. The local Audi just called and informed me that the timing chain tensioner gave up and the car has both piston and valve damage. The cost of full block and head replacement is close to 13K which is absolutely insane, for an Audi this is not acceptable. Does anyone have any suggestions?

    SAME problem here. We have an AUDI A5 and have to fill the oil back up approx. every 1500 miles, ridiculous. Am thinking of contacting the attorneys who handled the class action lawsuit for other victims. If I get any info will post here and hopefully all of you will join?

    My 2011 Audi Q5 was burning excessive amounts of oil between changes, it has steadily been getting worse (I’ve got about 65,000 miles on the car). So I brought it in to the Keys Audi Dealership in Van Nuys, CA (where I purchased the car), and they are replacing all the pistons at no charge. They say it will take 2 – 3 days, and they have put me in a loaner Q5 for the duration. This is all before I knew of the class action lawsuit (I just dropped it off today, and was googling tonight, and I just found this website). They we’re very attentive to the issue and seem to genuinely want to make it right. Maybe this dealership is better then others, the service dept. has always been good to me, but admittedly, I’ve always used them for service, and it’s not cheap, but its always been good, and I do love my Q5 (the best car I’ve ever owned, my previous car was a Mazda Tribute, before that I has a Toyota RAV 4…)..

    I have a 2011 A5. Goes thru excessive amounts of oil with only 53,000 miles on it. Have to add a qt every 1500 miles. When I called Autonation Audi dealer where I originally purchased my car, the idiot on the other end told me that my interior digital gauge only shows the top half of my engine oil level, not the bottom.? Wth does that even mean???!!!!! Glad I have enough car sense to know she is an idiot and called back to talk to my service writer who has a clue. Brennan informed me of the issue with these cars and sounds like I will be having some major engine repairs in the very near future. Then I will trade it in on anything but an Audi. Between the airbag issues Audi still has not found a permanent fix for and this? Too much time in the shop.

    Same thing (2009 A4); guzzles about a quart every 2 weeks. I dropped comments on Audi’s FB page and anywhere else I could. Their Care team called me, tried to work thru it, nothing they could do. Kept on pointing me to dealerships who couldnt do anything except acknowledge the issue and tell me its out of warranty and that paying to fix it isnt worth it.

    Never Audi again.

      Us too! 79K miles on a 2011 Q5. There is currently a pending class action suit for this issue with 24 named plaintiffs across 17 states. The flaw is with all 2.0T engines from VW and Audi from 2007 – 2012.

      Worst thing is, we took it in TWICE while it was under warranty with concerns over shuttering and gear slipping and we told there was “nothing wrong with the vehicle.” Now it is revealed that those symptoms are the precursor to the catastrophic engine damage caused by the timing chain failure.

      Just a bad is Audi/VW recognized the design flaw in 2012, redesigned the timing chain system, but kept consumers in the dark and advertised that the chain would last to 120,000 miles while simultaneously making sure they kept their extended warranty at 70k miles when tests showed the failure typically occurred around 80k miles.

    I see all the comments and sadly I have the same situation. A4 2011, abnormal oil consumption, arrogance from the Audi dealer in Highland Park, IL. they want me to pay a $1,200 before they even attempt to do the oil test. Never been so frustrated. So dissapointed about the so-called German engineering. Unable to sell the car since it is unethical to sell a defective car. Stuck, back to square one, NEVER EVER WILL GET AN AUDI AGAIN !!!

    I’m having the same issue. Purchased a certified pre owned 2011 A4 Quattro with 36k miles in 2014. The dealership never disclosed any of the issues with this model even though that must have been fully aware of the problem. I’ve had all of the manufacturer recommended maintenance and oil changes done at the dealership. The first time I got the low oil message I took my car in to have it checked. Was told by the dealership that while it was consuming more oil, it passed their test meaning the problem wasn’t bad enough for them to fix. Fast forward 7 months, I’m now having to add a quart of oil almost every week and today my car started to shudder while on the interstate and the engine light came on. Immediately took the car to the dealership and it’s the same issue I originally complained about only now they won’t fix it so any repairs will come out of my pocket. The guy I spoke with in the maintenance dept even acknowledged that the rings and piston were an issue and would have to be replaced at some point which makes me even more furious. They knew it was a problem from the beginning and never fixed it so I guess I’ll be fixing it myself and selling it. I’ve always wanted an Audi and when I finally got one, this happens. Needless to say this will likely be the last Audi I ever purchase and wouldn’t recommend anyone purchasing one either. It’s bad business for a company to treat customers this way.

    I have a 2011 Audi A4 with oil consumption issues that had the Pistons redone. I am continuing to have problems including the crank case regulating valve and the oil sensor switch, Audi is refusing to pay for these engine repairs.

      We have a 2010 Audi A4 that has this problem and after two “tests” by the dealer on the oil consumption they indicated that the oil light coming on after 4,000 miles is normal and no repair for the pistons required. I am furious!
      The dealer did not disclose this issue with the model when we purchased it.
