Kashi, Bear NakedConsumers who purchased Kashi and Bear Naked products that were allegedly falsely advertised as natural are receiving settlement checks in the mail from the Kashi and Bear Naked class action settlement funds.

Viewers of Top Class Actions are reporting that valid claims have been paid out and Class Members are receiving checks for as much as $328.22 from the Kashi class action settlement fund.

Kashi and Bear Naked FB Comments

The Kashi and Bear Naked settlements stem from two different class action lawsuits, Astiana v. Kashi Co. and Thurston v. Bear Naked Inc., which alleged that these two companies falsely advertised some of their food and snack products as natural, despite allegedly containing synthetic and artificial ingredients.

Specifically, the false advertising class action lawsuit filed against Kashi claimed the company marketed their foods as “All Natural” or “Nothing Artificial,” even though these snack goods allegedly used artificial ingredients, including pyridoxine, hydrochloride, calcium pantothenate and hexane-processed soy ingredients.

Similarly, Bear Naked faced allegations that they knowingly and purposefully misled consumers by labeling and marketing their products as “100% Pure & Natural” and/or “100% Natural,” even though these Bear Naked products were allegedly made with artificial ingredients .

Both Kashi and Bear Naked continue to deny any wrongdoing in these false advertising class action lawsuits and stand by their marketing and labeling statements. However, both health food companies have agreed to class action settlements in order to avoid the costs and uncertainty of further litigation.

To resolve false advertising class action allegations, Kashi established a settlement fund of $5 million, while Bear Naked agreed to pay $325,000 for their false advertising settlement fund. Additionally, both Kashi and Bear Naked have agreed to make certain changes to their current marketing and labeling practices for some of their food and snack products.

Class Members of the Kashi false advertising class action settlement include California residents who purchased certain Kashi products between Aug. 24, 2007 and May 1, 2014.

Class Members of the Bear Naked false advertising class action settlement include California residents who purchased certain Bear Naked products between Sept. 21, 2007 and May 1, 2014.

Under the terms of the Kashi class action settlement, Kashi Class Members who provided a receipt, retail rewards submission, or another form of written proof of purchase for the Kashi products included in this false advertising class action lawsuit could seek reimbursement of $0.50 per each product purchased. Class Members without proof of purchase could also seek the same reimbursement, though their maximum recovery without written proof of purchase was capped at $25.

Similarly, per the terms of the Bear Naked class action settlement, Bear Naked Class Members who provided written proof of purchase for the affected Bear Naked products could seek reimbursement of $0.50 for each product purchased. Class Members without proof of purchase could also seek the same reimbursement, though their maximum recovery without written proof of purchase was capped at $10.

The deadline to file claims for both the Kashi class action settlement and the Bear Naked settlement passed on Aug. 25, 2014.
