Checks are in the mail from several settlements with Avis, Google and other companies over a range of consumer issues including data breaches, price fixing and privacy violations.


Avis Budget e-Toll fees settlement checks

Top Class Actions readers are receiving checks from a $45 million class action lawsuit settlement with Avis Budget over e-toll hidden fees.

The settlement benefits consumers who rented an Avis or Budget vehicle and paid for e-Toll services between April 1, 2007, and Dec. 31, 2015. The class period is March 2, 2009, to Dec. 31, 2015, for rental transactions originating in Florida, Texas or Colorado.

Plaintiffs in the e-toll class action lawsuit claim that Avis Budget violated its rental agreements by charging hidden fees related to electronic toll payments. These fees allegedly violated state laws and took advantage of consumers.

Avis Budget agreed to pay $45 million to resolve the e-toll class action lawsuit. Under the terms of the settlement, class members could receive up to 80% reimbursement for eligible e-toll charges on up to seven rental transactions. Top Class Actions readers report receiving payments of $21.84 from the settlement.

The Avis Budget e-toll fees class action lawsuit is Mendez v. Avis Budget Group Inc., et al., Case No. 2:11-cv-06537-CCC-JSA, in the U.S. District Court for the District of New Jersey.

Hibbett FACTA class action rebates

Our readers report receiving payments from a $6 million settlement with Hibbett that resolved a class action lawsuit.

The settlement benefits consumers who used a credit or debit card at a Hibbett, City Gear or Sports Additions store between Dec. 15, 2020, and Feb. 23, 2022, who received a point of sale receipt that showed more than the last five digits of the card number.

According to the class action lawsuit, Hibbett included too many digits of payment cards on printed receipts. These receipts allegedly violated the Fair and Accurate Credit Transactions Act (FACTA) which limits the amount of information that can be printed on receipts. 

Hibbett didn’t admit any wrongdoing but agreed to pay $6 million to resolve the FACTA class action lawsuit. Under the terms of the settlement, class members could receive up to $20. Top Class Actions readers reportedly started to receive settlement payments from the deal. 

The Hibbet FACTA class action lawsuit is Cliatt, et al. v. Hibbett Retail Inc., Case No. CV-2022-90008, in the Circuit Court of Barbour County, Alabama.

ATM fees settlement checks

Settlement checks are in the mail from a $66 million deal with JP Morgan, Wells Fargo and Bank of America resolving claims that the banks charged illegal out-of-network ATM fees.

The settlement benefits consumers who paid an out-of-network ATM fee to JP Morgan, Wells Fargo or Bank of America between Oct. 1, 2007, and Nov. 12, 2021. 

Plaintiffs in the class action lawsuit claim the defendants conspired together to raise the cost of out-of-network ATM fees through an illegal antitrust agreement. This scheme allegedly caused consumers to pay significantly more in ATM fees than they should have.

The banks agreed to pay a combined $66.74 million to resolve the ATM fee class action lawsuit. Under the terms of the settlement, class members could receive a proportional share of the settlement fund based on the amount they paid in fees. Top Class Actions readers reportedly received hundreds of dollars in payments, with one reader reporting a payment of $1,143.78!

The ATM fees class action lawsuit is Andrew Mackmin, et al. v. Visa Inc., et al., Case No. 1:11-cv-01831 in the U.S. District Court for the District of Columbia.

Disposable contact lens price-fixing class action rebates

Top Class Actions readers have started to receive payments from a $75 million contact lens class action lawsuit settlement.

The settlement benefits consumers who purchased disposable contact lenses from Johnson & Johnson Vision Care, Alcon Vision, CooperVision, ABB Concise Optical Group and Bausch & Lomb between June 1, 2013, and Dec. 4, 2018. 

According to the class action lawsuit, the contact lens sellers conspired together to raise and fix the price of disposable contact lenses. The alleged antitrust agreement forced consumers to overpay for their contact lenses, the plaintiffs contend.

Alcon and Johnson & Johnson Vision Care agreed to pay $75 million to resolve the class action lawsuit, joining previous settlements with other defendants. Under the terms of the settlement, class members can receive a share of the settlement funds based on the amount they paid for contact lenses. Our readers report settlement payments of hundreds of dollars, with some receiving over $1,000 and the largest payment at $2,118.65.

The contact lens class action lawsuit is In re: Disposable Contact Lens Antitrust Litigation, Case No. 3:15-md-2626-J-20JRK, in the U.S. District Court for the Middle District of Florida, Jacksonville Division.

LifeBridge Health data breach settlement checks

Our readers have reported receiving settlement payments from a $9.5 million settlement with LifeBridge Health resolving a data breach class action lawsuit.

The settlement benefits consumers whose personal information was compromised during a LifeBridge Health data breach announced in May 2018.

The 2018 LifeBridge Health data breach allegedly compromised the names, birth dates, Social Security numbers, health information and other data of 530,000 patients. Plaintiffs in the class action lawsuit claim that LifeBridge failed to implement reasonable cybersecurity measures that could have prevented the data breach.

LifeBridge Health agreed to resolve the data breach class action lawsuit with a $9.5 million settlement. Under the terms of the settlement, class members could receive reimbursement for data breach-related expenses and losses. Top Class Actions readers reportedly received $60 payments from the settlement.

The LifeBridge data breach class action lawsuit is Johnson, et al. v. LifeBridge Health Inc., Case No. 24-C-18-006801, in the Circuit Court for Baltimore City, Maryland.

Top Class Actions viewers reportedly received payments from a $100 million Google class action lawsuit settlement resolving privacy claims.

The settlement benefits Illinois residents who appeared in a photo in Google Photos between May 1, 2015, and April 25, 2022.

According to the class action lawsuit, Google allegedly violated the Illinois Biometric Information Privacy Act (BIPA) by using facial geometry to identify people in photos without obtaining consent, issuing proper disclosures or maintaining a public schedule for retention and destruction of the information.

Google agreed to resolve the privacy class action lawsuit with a $100 million settlement. Under the terms of the settlement, class members could receive a cash payment. Readers report receiving $95.38 from the class action lawsuit settlement.

The Google BIPA class action lawsuit is Rivera, et al. v. Google LLC, Case No. 2019-CH-00990, in the U.S. District Court for the Northern District of Illinois.
