AutoZone Wage & Hour Overtime Class Action Settlement

AutoZoneAutoZone, Inc. (NASDAQ: AZO) has reached a class action lawsuit settlement concerning wage and labor violations suffered by California employees. As a result, anyone who worked in an hourly position at an AutoZone store in California within the past 10 years may be able to file a claim to receive back pay of unpaid overtime, minimum wages and more.

The AutoZone employee class action lawsuit settlement will resolve a 2005 lawsuit, entitled Carl Myart v. AutoZone, Inc., that alleged hourly employees were not paid all regular and overtime wages owed to them, were not properly paid minimum wages, were not reimbursed for uniform-related expenses, were not provided properly itemized wage statements, and were not timely paid all wages owed at the end of their employment.

Specific allegations in the AutoZone overtime class action lawsuit were that AutoZone failed to:

— Reimburse or otherwise compensate non-exempt employees for the purchase and maintenance of uniform clothing;
— Properly and fully compensate non-exempt employees for all time spent working after clocking out or being clocked out at the end of store closing shifts;
— Properly and fully compensate non-exempt employees for responding to store alarms;
— Fully and timely pay all wages owed to employees who were discharged or who quit;
— Make, keep and preserve accurate and complete time and payroll records; and
— Provide complete and accurate wage statements, in violation of the federal Fair Labor Standards Act (FLSA).

AutoZone denies any wrongdoing but has agreed to establish a $4.5 million class action settlement fund to resolve the litigation.

As part of the AutoZone overtime class action settlement, AutoZone has agreed to modify its timekeeping procedures so that hourly employees working a closing shift in California stores and working through the completion of their store closing tasks may remain “on-the-clock” and be paid for all time spent completing the store closing, including the setting of the store alarm.

AutoZone has also agreed under the class action lawsuit settlement to pay California workers a portion of the $4.5 million settlement amount, which will be calculated by determining the total number of shifts worked by all Class Members during the Settlement Period from February 16, 2011 through May 19, 2011. The Net Settlement Amount will then be divided by the total number of shifts worked by all Class Members to determine the amount each Class Member shall be eligible to receive for the Settlement Period.

Class Members who are currently employed by AutoZone as of May 19, 2011 and do not opt-out of the AutoZone wage and hour class action settlement will receive a settlement award without filing a claim. Class Members who were no longer employed by AutoZone as of May 19, 2011 must submit a Claim Form to receive a settlement award. Class Members who were no longer employed by AutoZone on May 19, 2011 and file valid and timely claims and Class Members who were currently employed by AutoZone on May 19, 2011 and do not opt-out of the Settlement shall be known as “Participating Class Members”. Participating Class Members will be paid settlement awards based on the number of shifts they worked during the Settlement Period.

The deadline to file a claim for the AutoZone overtime class action settlement is September 27, 2011. The deadline to exclude yourself is also September 27.

    How do I find out why I didnt receive mt settlement check? Everyone I know has received their check already….ive been employed since april 14 2008. Derrick

    my mother received a phone call about this settlement as i no longer live with her. she called me immediately after to give me the telephone number. i then called and requested a claim form because i had never gotten one. that was monday 9/19/11. i received a call from one of the representatives the following day. she stated the deadline was in 1 week and it had to be postmarked by 9/27 and she would mail out the form that day. it has been 1 week, it is now the day of the deadline and i have no form to mail. worst part is… i can not reach a real person to see if there are any other options such as email. i’m very frustrated and i hope that there is some way that i can still file my claim. i hope that because the mail man didn’t have it today i will not have to suffer the consequences.
