Marriott Vacations Worldwide violates the law by placing unsolicited telemarketing calls to consumers across the country, a new class action lawsuit alleges.
Plaintiff Jane Heller claims Marriott conducts “wide scale telemarketing campaigns” and repeatedly makes unsolicited calls to consumers, including those who have their numbers listed on the National Do Not Call Registry.
Heller argues Marriott violates the Telephone Consumer Protection Act (TCPA) by allegedly placing the unsolicited telemarketing calls.
“The TCPA was enacted to protect consumers from unsolicited telephone calls exactly like those alleged in this case,” the Marriott Vacations class action states.
Marriott Vacations class action claims company causes actual harm to consumers
Marriott causes actual harm to consumers who received the unsolicited telemarketing calls, including “aggravation, nuisance and invasion of privacy,” the Marriott Vacations class action alleges.
“In Defendant’s overzealous attempt to market their services, it placed phone calls to consumers who never provided consent to call and to consumers having no relationship with Defendant,” the Marriott Vacations class action states.
Heller demands a jury trial and requests injunctive relief along with an award of actual and statutory damages for herself and all class members.
Heller wants to represent a nationwide class of consumers who have received more than one telemarketing call in a 12-month period from Marriott Vacations in the past four years to a number listed on the National Do Not Call Registry.
In other Marriott news, in July, Marriott agreed to a settlement made to resolve claims the company failed to provide employees at its New York Marriott Marquis Hotel with a proper severance package after they were furloughed and ultimately laid off during the COVID-19 pandemic.
