Consumers who registered their phone numbers to opt out of unsolicited spam and solicitation phone calls but continue to receive them may be able to pursue compensation by filing a Do Not Call List violations lawsuit.
What is the Do Not Call List?
The Do Not Call List is a national list of phone numbers, maintained by the Federal Trade Commission (FTC), and intended to protect consumers from harassing spam calls.
Consumers who register their numbers with the list are protected from receiving unwanted sales and solicitation calls. It is free for consumers to register their numbers by contacting the registry by phone or visiting its website. Registration never expires.
Solicitors and telemarketers who call or text numbers listed on the Do Not Call List are subject to a variety of penalties for these violations.
What Kinds of Calls Are Covered by the Do Not Call List?
Consumers who have registered their number with the list and are still receiving unwanted solicitation calls are recommended by the FTC to block the calls and report them via the FTC’s complaint assistance site. Not every type of call is covered by the Do Not Call List. Political calls, debt collection calls, charitable calls, and surveys are exempt from the list.
While the Do Not Call List cannot stop calls from certain companies, it is supposed to protect consumers from telemarketing, solicitation and robocalls. The FTC says that consumers who have been harassed by these calls may also be able to file a lawsuit against the violating solicitors to pursue compensation for these nuisance calls.
Can You Sue for Do Not Call List Violations?
If you have been harassed by robocalls or spam calls despite having your number registered with the Do Not Call List, you may be able to file a lawsuit to stop the calls and pursue compensation. Companies that illegally place spam calls to numbers registered with the list may be subject to fines of up to $42,530 per call.
One recent class action lawsuit regarding Do Not Call List violations resulted in a $25 million settlement agreement and required the violators to provide free services to the plaintiffs.
What is the Telephone Consumer Protection Act?
Like the Do Not Call List, the Telephone Consumer Protection Act (TCPA) was created for the purpose of protecting consumers from unwanted solicitors. Under the terms of the TCPA, telemarketers are prohibited from calling consumers before 8 a.m. or after 9 p.m. local time, refusing to disclose information about who is calling, calling consumers who have not explicitly consented to be contacted, and using an autodialer to send mass, pre-recorded calls to consumers, among other restrictions. Consumers who have been subjected to TCPA violations may be able to sue for between $500 to $1,500 per violation, according to NBC News.
If you have received spam and solicitation calls despite your number being registered with the Do Not Call List, you may be able to sue the offending companies for these Do Not Call List violations and pursue compensation.

If you were contacted on your cell phone by a company via an unsolicited text message (text spam) or prerecorded voice message (robocall), you may be eligible for compensation under the Telephone Consumer Protection Act.
